Ah, so for the techno savy out there, lets take a break from putting down this radio and lets come up with a strategy for plugging the hole! What are the legal issues concerning monitoring the cell frequencies. Certainly, you can't disclose to third parties, but I don't think anybody can stop you from listening. The fathers' of the constitution may not of had this (radio) in mind but I think it is ok.

FRED,
The legal issues are very real. It is in violation of the Federal wireless privacy act to intercept (receive) any cellular transmissions analog or digital signals, period. It is also against the law to manufacturer equipment that is "easily modified" to do this as well.
Another FCC rule says it is illegal to reveal what you monitor on your radios to a third party.

Hello All,
?
Just an FYI,
?
Most ALL cell phone systems today are digital in nature so monitoring with a conventional radio will not work so I would not even be concerned about this any longer.
?
Most if not all Cell phones manufactured today are digital in nature!
It is good though that the FT-60 works in this band as I am sure there are other services which will end up there at some point in time.

Remember that there are still a lot of analog cell towers in use, and even more cell phones that still have analog capabilities. Therefore you are still able to hear those people that are using the analog side (especially in less populated areas) and/or in areas where there's so many people using the towers that some peoples phone switch (roam) to the analog side so that the call can still be made.

The activity (listening to cellular conversations) prohibited by the statute is a "crime of specific intent". That is, you must intend to tune and listen to the conversation; not just accidently find it as a result of your dabbling in electronic projects. Now, if you discover the transmission and keep the device to listen to future calls ... or build one whenever you feel like listening, that is a violation of the law. ---------------------------------------------------------------------------------------------------------------------------- Milepost 11 - UPRR Jeff City Sub - N 38°34'53", W 90°22'32", 680' "We sleep safe in our beds because rough men stand ready in the night to visit violence on those who would do us harm"

FRED,
The cellular companies years ago convinced the FCC and the Federal Government to make the privacy act law. Unfortunatley you are correct. If you build your "homebrew" and it can receive cellular, or any other transmissions protected by the Act. Yup we would be in violation. That is why it took many years for the digital scanners to become REALITY.
Uniden had to prove the digital scanners did not violate the privacy act.

The link reference is dated 1995.
I would note that the LA county law prohibing receivers from 1600 to 2500 kHz overlaps with the new FCC extention of the AM broadcast band to from 1600 to 1700 kHz (though possission of a factory equipped or equivalent aftermarket AM radio in a late model automobile isn't likely to get you into trouble I wouldn't think. Also odd is the limitation on 150-160 MHz, as this includes the 156.050 to to 161.925 MHz VHF marine radio band -- though I suppose the possision of an FCC marine VHF license would cover you is you had a marine radio in your position, much as an amateur or GMRS or other FCC license would.
In general it appears they are trying to limit scanning of law enforcement frequencies.
As for ME it appears they are not restricting 200-500m transmitters per se, just ones causing interference, so an unlicensed Part 15 transmitter should be legal if it didn't interfere with MF marine or AM broadcast stations.

You could also get a very old television the kind with the old dials on them, and tune it to the upper UHF band. Certainly, you can't disclose to third parties, but I don't think anybody can stop you from listening. 73 de KE2QR Fred Jacobowitz _._. _ _ ._ _.. . _._ . .._ _ _ _ _._ ._.
