The activity (listening to cellular conversations) prohibited by
the statute is a "crime of specific intent". That is, you must intend to
tune and listen to the conversation; not just accidently find it as a
result of your dabbling in electronic projects. Now, if you discover the
transmission and keep the device to listen to future calls ... or build one
whenever you feel like listening, that is a violation of the law.
