The cellular companies years ago convinced the FCC and the Federal Government to make the privacy act law. Unfortunatley you are correct. If you build your "homebrew" and it can receive cellular, or any other transmissions protected by the Act. Yup we would be in violation. That is why it took many years for the digital scanners to become REALITY.
Uniden had to prove the digital scanners did not violate the privacy act.

The legal issues are very real. It is in violation of the Federal wireless privacy act to intercept (receive) any cellular transmissions analog or digital signals, period. It is also against the law to manufacturer equipment that is "easily modified" to do this as well.
Another FCC rule says it is illegal to reveal what you monitor on your radios to a third party.
What are
the legal issues concerning monitoring the cell frequencies.? Certainly, you
can't disclose to third parties, but I don't think anybody can stop you from
listening.??
