Real Estate legal question.

Since you guys know everything….

The property we are negotiating for right now has an easement issue. Anybody here up on real estate law?

We are calling a real estate lawyer to set up a consultation, but I’d love to have some idea about our situation.

I’ve googled till my brain hurts.
Thanks!

Connie

Are "they" on "your" property ... or are you on theirs??
For starters :-)
erica ... surrounded by easements

As far as I remember, an easement gives a right of use of a portion of the property to someone else (like a neighbor) or to the world at large.
So you need to know what the easement is, and who has what rights on your property, to start with.

But since it's a right against the property, it may diminish the value and that among other things is a negotiating point for price.
What happens next depends on your jurisdiction.

Not a real estate lawyer but the things I would want to make sure I knew were a) who has the right to the easement and what do they have to do to live within that right, b) what restrictions does that put on the property and c) what am I willing to live with.

As Lise says, it is a bargaining chip as it reduces the value of the property.?

The utility companies have an easement on the first 4-6 ft of my property along the road because we have underground utilities. They can dig it up - including the driveway and the lawn and any flower/shrub plants I have - but they have to supposedly put it back the way it was. Now, the plants don’t always survive the time out of the ground and that doesn’t show up till later. Therefore, I don’t plant anything big or valuable there. Annuals and daylilies and daffodils are it. They’ve dug up the driveway once and the lawn/flowerbed twice.

It’s hard to say. ?The property line runs down the driveway. Sometimes more on “their” side and sometimes on what would be “our” side. ?But they own more of it. (The easement)

Have you met them?
Do you have room to put in your "own" driveway?
