New Coal Cars

Is there any reason ( besides the obvious - more capacity per car ) for the UNPX bathtub gondola coal cars to be basically pulled from service and replaced with the ALMX, LUSX and NOKL cars? And does anyone know if additional cars are on line and what reporting marks they might be. Thanks. Tim.

A number of my trips from Moncton, N.B to Saint John, N.B. During The
Above Periods.

The late Fred V. Stephens of Moncton-His Life Was Railroads provided
some of the motive power movements, such as motive power on westbound
freights out of Saint John-going through the record books on his visits
to the Bay Shore Roundhouse at West St. John. Other information from my
own records. Fred passed away very suddenly in September of 1972. He
left behind a "Gigantic" collection of Canadian Railways. Omer Lavalee
of CPR in Montreal, made sure where his collection went to-Fred's wishes
between Fred and Omer.

It's not a 310-07 because that will be a grain loads and they are not
running through Chalk River Sub. I know that CP 9004 arrived in Montreal

the one of yesterday left Smith Falls very early this morning around
03:00am.

I usually make allowances for those who make respond to a posting before
they may have read their e-mail in its entirety, resulting in a
continuation of a discussion that has been shut down for being off-topic
etc.

The copyright topic, while perhaps about a CPR publication, is outside the
scope of
this particular list. It is, like many other topics on these e-mail lists,
a topic that is recurring in nature, and we all get to read the same
arguments again and again, much like the "favourite paint scheme" or
"Amtrak funding" debates, or worse yet, virus warnings. Personally, I
agree that it is an important issue, but 99% of the folks here expect to
talk/learn about the C-P-R. Please continue it off-list if you must, or
perhaps on a writer's guild list of some sort.

That way, CP are saving money $$ because empty grain trains are less
expenses to run (pay OVR by Tons) , So when they have loads of grain
they used their own tracks.

Just took delivery of my CPR Wood Combine from Dan Kirlin.

To all those that have been patiently awaiting this model, it is a beauty.
The underfloor detail is really well done. I haven't completly decided yet,
but I think I will be taping the baggage doors shut after the model is
painted. A "parts" bag comes with the model which contains an end diaphram,
marker lights, hoses and an extra stove pipe.

Guess the paint shop will be open this weekend.

Dan said all models to those who have pre-ordered should be in the mail by
the end of the week.

I was hoping this discussion would be allowed to continue a while longer and not be nipped in the bud quite so quickly. The publication of data and information is fundamental to the hobby of railfanning and model railroading. Even more so now with the instant communication provided by the Internet.

I was wondering how list members feel on the subject of copyright regarding this list and the railway web sites currently online? Bryce Lee has been publishing on the Internet for quite some time. I would like to hear his public opinion regarding Internet copyright.

In the preceding discussion the outcome seems quite clear. Roger is an author who expects to be paid for his creative effort and must protect his copyright which has obviously been infringed. Recompense is obviously due.

But what about information contained in this list? If I take something and publish it for profit am I stealing the Poster's copyright? If I publish a photograph from someone's personal website am I stealing their copyright?

My feeling is anything you may publish on the Internet, unless on a secure server with restrictive password entry, is in the "Public Domain". This includes this list. This would therefore leave me free to quote what and where I like, with or without credit. Etiquette and prudence suggest I ask forgiveness from the author in advance, but I don't believe it is necessary. The Author may then feel ripped off but what is his/her damages? If you publish to this list, the web, or the internet, you place a value of zero on your efforts because you gave it away freely. How could you claim damages in a court of law?

Therefore, the Internet, particularly this list, is primarily about the FREE sharing of information. If someone uses your utterances I don't believe as the author or photographer you have any recourse.

I guess where I'm going with this is how do we obtain quality online railfan/modeller publications? How do the Author's or contributors get recognized and paid for their efforts? Bryce Lee's "Canada Calling" is an example of excellent work no longer available. Do we want it this way?

This thread doesn't belong here. However, a quickie comment:

Anything an individual does... web site, photograph, software etc... you are
automatically copyright protected even without registering (as long as it
wasn't done on contract for someone else, then they own the copyright to the
work).

My website just happens to be copyright registered with the feds (30 bucks).
All this does is give me more legal footing should I have the time and money
to go after someone for a violation.

This is a really touchy topic. To add to Joe's comments, I have run into
plagiarism problems too, only they are web-related. I maintain a site that
describes the Northlander TEE trainset that ran on the ONR (I'm really going
to have to work o get a CP connection here..<g>.) that is by no means
comprehensive, however, it did take time to research and it was posted
because I could not find any other place like it, nor any info about the
trainset. I figured if I was interested, others would be too. I guess a
writer for Canadian Railway Modeller felt the same way, because a recent
article in that magazine on the trainset plagiarized the content I had
posted. Though some attempts were made to rewrite portions of my material,
a lot of the information in the article came from my research witout
attribution (to the point that a number of the passages were directly lifted
from the site). This constitutes plagiarism. As an academic, I was somewhat
concerned based on the principle that had been violated, but what was of
more serious concern is the fact that the material that I researched and
wrote up has now appeared in print without attribution, and given the nature
of the 'net, de facto ownership of that intellectual property could rest
with CRM, since they have copyright protection and I don't.

I contacted CRM's editor, Morgan Turney about this problem, who admitted the
author had "borrowed heavily" from the site. He also assured me that
suitable attribution would appear in a future issue. So far this has not
occurred, but give publishing deadlines and lags I will wait a while longer
to see what happens. Really, what other recourse do I have?

People who provide information for us in the hobby, either by writing books,
posting informative websites, etc., are doing this out of interest and to
help others. It is a selfless task. I am in no way comparing writing a
book to creating a web-site- the former is a much more labour intensive
exercise, but both are usually examples of people attempting to communicate
their interests and knowledge to others. Without such people we would be
much worse off.

Bottom line- Interested people who are willing to share is the foundation of
the hobby we pursue. We cannot risk alienating people or taking advantage
of their efforts without appropriate recognition for the services they
provide. To answer the original questions posed by Rodger- I think CP
Tracks should IMMEDIATELY publish a very obvious comment on the first page
of the publication that addresses Rodger's concerns. They should also make
internal changes such that this probelm will not happen again. If they
don't, the publication will find itself on the receiving end of costly
litigation that will drive it out of existence from some future incident of
the same sort. Rodger's comments here would be adequate proof in future
cases of past plagiarism, and of the lack of concern the publication has
with respect to this issue, which might ensure a more serious judgement.
This makes it all the more important that CP Tracks takes care of this
matter now, while they still can. It would be bad enough if the cooperation
and service of people like Rodger Burrows was lost to our community. It
would be even worse if the only publication the SIG really has was lost due
to such mismanagement.

Roger and Patrick have touched upon a problem that I've run into myself.
About 2 years ago, I was more than a little surprised to walk into the
model railway display at the S.S. Sicamous in Penticton and find a
photocopy of an article I wrote for Canadian Railway Modeller, plastered
to the edge of the layout. There was (and the last time I looked) no
credit for either myself or CRM. I requested the club to credit myself
and CRM for the article and was promised that would be done. Guess
what?! When I looked last fall, the article was still there and no
credits. I don't know what Morgan Turney's thoughts are about the
matter, but when I recently discovered this credit had not been
forthcoming, I too found myself wondering what to do.

I have too many other things on my plate right now to pursue a
relatively small matter a long way from home, but I sure understand how
Roger feels. One hell of a lot of time, trouble AND money has gone into
rounding up the material that we use in our publications. I'm glad that
people saw my article worthy enough to display, but it seems to me that
at very least, common courtesy would dictate that myself or CRM was
approached first and then given due credit. The same goes for CP Tracks
with Roger.

I don't know about Roger's future course, but at some point the fellows
in Penticton are going to hear more about my matter. It is not a
pleasant feeling to be so completely disassociated from a personal
labour of love.

I hope this is considered "on topic" for Observation Car, and that I
can get
some constructive comment from some members who are in the publishing
industry.

Back in the 1980's I produced two books entitled "Railway Mileposts:
British
Columbia". Perhaps some of you are familiar with them. I know that
both
Dale and Brian at CTC Board, Bruce Kelly when at R&R, and the
listmeister
have all used my Mileposts books and have commented favorably.
Volume I
covered the CPR mainline route and Volume II described the "Southern
Routes", including CPR's Crowsnest - Kettle Valley Route and the
Great
Northern routes in southern B.C. Both relied heavily on scale maps
in
describing the rail routes.

In September 1998, I picked-up a copy of "CP Tracks", a publication
of CPR
SIG which is a special interest group of the NMRA. I was surprised
to see
an article that "borrowed" heavily on one of my books. Hell, it
copied some
of my maps and one of my photos, without permission.

So, I e-mailed Dave Love (CP SIG's president[?]) and Glen Moffat (CP
Tracks
editor), sending the following letter which I thought was quite
reasonable
under the circumstances. It read:

"I was surprised recently when I picked up a copy of the "Summer
1998" issue
of "CP Tracks".

"Peter Abel's "Kettle Valley Memoirs" includes several maps, data,
and a
photograph, all taken I believe, directly from my book "Railway
Mileposts:
British Columbia, volume II, the Southern Routes", copyright 1984.
Although the photograph was credited to me, the data and maps (which
were
only slightly modified from those that I made for the book) were not.

"I don't recall giving Mr. Abel (or others) permission for this use.

"I often grant permission for such use by non-profit organizations on
the
condition that proper credit is given, and that I receive a copy of
each
publication. For example, the Nelson-area rails-to-trails group
recently
included materials from one of my books in their brochure on that
basis.

"I don't want to appear to be to be too much of a curmudgeon about
this, and
I don't want to discourage the valuable efforts of CP SIG, but I
believe
that proper credit (and an explanation) is due. BTW, volume II of
"Railway
Mileposts: British Columbia" remains in print."

I had a phone call in response to my e-mail, including a verbal
apology and
a promise to look into things. I heard nothing more, no explanation,
no
request for permission, nothing. Neither verbally nor on paper.

So, it was with some amazement recently that I found two more issues
of CP
Tracks (Summer and Fall 1999) at my local hobby shop, both of which
included
maps copied directly from my books. Each recent issue included two
or more
of my maps, reproduced up to full page size, none of which was
credited to
me (the copyright holder) or to Railway Milepost Books. (There is
however a
short list of "references" in the article which includes the title of
my
book along with several other titles.) A list of back issues inside
the
back cover of CP Tracks indicates that the Fall 1999 issue is the
fifth
issue to include Kettle Valley Memoirs, presumeably all with my maps
copied
from my books.

Now don't get me wrong, I enjoyed producing Railway Mileposts:
British
Columbia. But I did not commit my time and invest considerable sums
of
money for questionable return, only to have someone simply copy a
valuable
part of my work without permission and without credit. Drawing the
maps was
probably the most tedious and time-consuming part of the project.
They were
drawn by me by hand in ink on mylar. Not only that, the book from
which
they were copied remains in print, that is, we have copies to sell.

CP Tracks says in its recent issues "This publication and its
contents may
be copied for non-commercial use only - the author, CP Tracks and CPR
SIG
must be credited". So, not only have they copied my material without
permission or credit, but they are permitting unlimited
non-commercial use
of my material with their credit. Nice. CP SIG apparently has about
500
members, and sells additonal copies of CP Tracks for $5.00 each (I
don't
know the total publication numbers).


So, what do I do???

Some things that spring to mind include some or all of the following:

1. Take legal action (after all, my wife works for a law firm)

2. Demand restitution (based on what?)

3. Demand a full printed explanation and apology

4. Require them to purchase unsold books at list price

5. Demand free advertising equivalent to the column-inches of my
maps
copied

6. Other suggestions?
