Why the SCOTUS EPA decision is so important
While?the?Dobbs decision was getting all the attention last week, a decision that was way more far-reaching also emanated from SCOTUS, as they reined in the power of the EPA for overreach.? Essentially, they began to dismantle the?Administrative Procedure Act(APA).?This is the act that empowered various Federal agencies to write and prosecute their own laws with absolutely no Congressional involvement. Neil Gorsuch writes in his book, "If You Can Keep It," about the almost arbitrary way that these agencies change their policies, making it nearly impossible for citizens to comply. One minute a practice is against the law, the next minute, a new Administration has repealed the law. It's madness, but nobody knows about it.

Meanwhile, in Arizona for your proof pleasure
From the Arizona Sun Times: https://arizonasuntimes.com/2022/06/11/maricopa-county-spokesperson-admits-20000-late-ballots-were-scanned-before-verification-expert-says-likely-a-crime/ In an email exchange with? The Arizona Sun Times?this week, a Maricopa County Recorder¡¯s office spokesperson may have unwittingly admitted that the county mishandled thousands of ballots from the 2020 general election that one watchdog groups??were accepted after the legal deadline. Megan Gilbertson, the communications director for the Maricopa County Elections Department (MCED) ¨C a department of the Maricopa County Recorder¡¯s Office ¨C said that the department processed ballots by scanning them into the tabulating machines at MCED before transferring their custody the next day to?, which verifies their legitimacy with signature verification. She stated, ¡°Due to the large volumes of early ballots received Election Day, we are scanning in early ballots received by 7 p.m. on Election Day well into the next morning, which is why a transfer of custody document would have a date after Election Day.¡± In an earlier email, Gilbertson noted that ¡°early ballot envelope signatures that are cured would also be tracked and scanned after Election Day until the curing deadline. None of these ballots would be marked as rejected, as they were all received by the Elections Department prior to 7 p.m. on Election Day.¡± Gilbertson added that although the receipts are dated after Election Day, the ballots weren¡¯t late because they were either cured ballots (Arizona law provides five days after an election to cure ballots) or took extra time to transport to?, their third-party private vendor, due to scanning them first at MCED. Maricopa County elections officials contracted with?, a Phoenix-based business founded in 1972 by Chuck Runbeck. According to the company¡¯s website, the firm specializes in ¡°customized election solutions, reaching more than 70 million voters¡± and touts its services ¡°are conducted from our state-of-the-art, secure facility ¨C designed specifically for the production of election-related materials.¡± The county contracted with Runbeck Election Services to provide signature verification for the ballot affidavits contained on the ballot envelopes. The ballot receipts, the county spokesperson said, are drawn up when MCED drops the ballots off with Runbeck for??¨C not when they come in from the United States Postal Service (USPS). She wrote, ¡°We have bipartisan staff that pick up envelopes from USPS. That staff delivers these envelopes, each with a unique intelligent barcode, to the Elections Department. The envelopes picked up from the post office are then delivered to Runbeck along with the early ballot affidavits dropped off at voting locations on Election Day.¡± The Sun Times?asked Gilbertson to confirm her statement that ballots go directly from USPS to MCED first, then to Runbeck. ¡°Yes,¡± she answered. The Sun Times?shared the information from Gilbertson with an Arizona election lawyer, who said that under the state¡¯s elections law, tabulating an unverified ballot is a crime. The attorney pointed to three separate provisions of Arizona state law. First, 16-550(A) of the Arizona Revised Statutes (ARS) states that the first action by elections officials upon the receipt of a ballot is to verify its authenticity by comparing the signature on the affidavit (on the envelope) to the corresponding signature in the county record. A. On receipt of the envelope containing the early ballot and the ballot affidavit, the county recorder or other officer in charge of elections?shall compare the signatures thereon with the signature of the elector on the elector¡¯s registration record.?If the signature is inconsistent with the elector¡¯s signature on the elector¡¯s registration record, the county recorder or other officer in charge of elections shall make reasonable efforts to contact the voter, advise the voter of the inconsistent signature and allow the voter to correct or the county to confirm the inconsistent signature. ?(emphasis added) Second is ARS 16-1009, which classifies the offense for public officer(s) who do not follow the procedures in the way the law describes. A public officer upon whom a duty is imposed by this title, who knowingly fails or refuses to perform that duty in the manner prescribed by law, is guilty of a?class 3 misdemeanor. (emphasis added) Third is ARS 16-1010, which further classifies an election official¡¯s failure to follow lawful procedure with regards to elections. A person charged with performance of any duty under any law relating to elections who knowingly refuses to perform such duty, or who, in his official capacity, knowingly acts in violation of any provision of such law, is guilty of a?class 6 felony?unless a different punishment for such act or omission is prescribed by law. (emphasis added) In Arizona, each count of a class 3 misdemeanor is punishable with up to?. One count of a class 6 felony is punishable with up to?. Arizona Republican Party Chair Kelli Ward told? The Sun Times, ¡°I don¡¯t trust a word that comes out of the Maricopa County Election¡¯s Department nor from the County Recorder and his staff. They¡¯ve got a history of incompetence, law breaking, and obfuscation related to election integrity and this is just another instance. ¡ it looks like they¡¯ve got something to hide.¡± ?

I went back to the video last night to double check that is the only option. It is as far as I can tell. ? While there, I came across the True the Vote people and their connection with that video.? Hence I Googled them and sent you the link about their law-breaking, corrupt ways and their proliferation of the big lie and capitalizing off of same.? So one thing led to another and frankly, if what was stated is true about their business operation, they need to be put out of business and I may have mentioned, I have no problem with filing complaints against them with the AG.? ?That¡¯s called action.? I posted the link not as any kind of response but as an FYI ?for your consideration as I assumed you were unaware of this. ?It¡¯s either that or you and all of your friends here already know but do not care about the truth.? That¡¯s a different matter altogether. ? I asked you for the facts you stated are in that video because I cannot see the video.? So, are you going to share? You saw the video; I presume you can tell me what you saw. ? The only actionable data presented to me so far is the link you sent re PA corruption. I acknowledged that and you notice action is being taken by the proper authorities.? That is exactly what I am looking for.? Got any more? ??I¡¯m looking for legitimate causes for action. ??Think I¡®ve said that before. ? I imagine you would like to be heard by people outside of the Republican Party and little clandestine groups like this one.? Then this is the kind of information you will have to provide to gain credibility outside of any group that parrots the same old crap ad nauseam and no, you are not getting special treatment; I have to do the same thing. ? My work with homeless people should not be construed as virtue signaling.? The point in that example is the breadth of the human spectrum I engage with: All levels of society, All races, All religions and the list goes on. I have a long list of gay men friends. Let¡¯s hope that is not a faux pas in any circles in present day Los Angeles, CA. ? I have yet to see any facts that cannot be refuted by good authority or any reasoning other than glimmers of your own.? All I have seen are other peoples¡¯ opinions and beliefs and people telling each other how to vote. I did encounter one fellow who was having a hysterical fit due to his interpretation of some proposed legislation. When I asked him where he saw that his response was, oh it¡¯s in there.? Well it was not in there; what was in there was his own misinterpretation of what was stated and that is why he could not tell me where it was.? THIS is the typical response I get when I ask someone for factual data. ? Here is the tax return for True the Vote for 2019.? They have not filed the 2020 return which would have been due 10/15/21 if on extension so they are way past due.? This tax return is another example of the kind of factual data I rely on. ? Yes, in fact, there is a loan for $113k+ to Catherine so that is absolutely true and absolutely AGAINST 501c3 regulation.? The return was filed 2/17/22? so you can say they are running behind, way behind. ? She also took more than 1/3 of the less that $450k in donations received in 2018.? (The tax return was filed late 1/11/21).? I want a job where I get 1/3 of the gross income!? Who is she anyway?? Just an enterprising woman with a pretty face who saw an opportunity to make money off of promoting a lie to others? It¡¯s amazing how stupid the masses are and how sad that is, especially when folks who may be a tad smarter take advantage of the less sophisticated.? Present day morality in the US is another issue entirely. ? So there you have it; I posted a link as an FYI then I pulled and read the tax return to check the statements made in the link and imagine that, the news article (regardless of who wrote it) and the tax return match. ?I call that verification of data not open to anyone¡¯s interpretation.? See how simple that is? ? Enjoy your weekend. ? ~CL ? From: [email protected] <[email protected]> On Behalf Of sonja nyman via groups.io

For me, I care less about?what people think than?why they think it.. That's the problems I have with your responses: There's no meat there.? No rationale.? Simply posting links to a biased reference is, unfortunately, what most people on the internet think of as an intelligent response.? It's not.? It's just laziness. ? On another note, someone invited me to this group long ago; I didn¡¯t know the person and don¡¯t recall their name.? I suspect now it was because this group is so different and of one mind.? They sent me here to see what the other side of the world is doing and perhaps to shake things up a bit; to shake people out of their complacency. ? ? I engage in dialog with people from all walks of life and have entertained people who were homeless along with Doctors and Lawyers at the same event.? I¡¯m genuinely interested in other peoples¡¯ point of view and have a true desire to understand other people and their needs.? That does not imply I will go down any rabbit holes because of what someone else believes. ? No need to go down any rabbit holes.? However, reviewing the reasoning and data that forms others' opinions can be more rewarding and enlightening than virtue-signaling about homeless people.? It's easy to talk the talk.? Amongst these folks, you need to walk the walk if you want to be taken seriously. ? All I have asked for are facts that I can research and form my own opinion about (I do not need someone to tell me what I should think or do).? Back to the facts, ?none have been presented even by those who claim to have them.? I keep asking:? why is that?? Either you have the ¡°facts¡± or you do not just don¡¯t claim you do if you do not because sooner or later, someone like me is going to ask you to present them.? ?That¡¯s how it works. ? ? Kudos to Rob who presented one factual article about corruption in PA prior to 2020.? And yes, it¡¯s real and guess what, those people are being prosecuted, as they should be.? Works for me and I do not care what party they belong to. ? Thanks, but now you need to see?2000 Mules to see just how widespread the voter fraud really is -- and that's just one means of fraud.? It doesn't even begin to address the other events that involved far different means. ? My request for the facts this group claims to have is wholly reasonable and I can¡¯t help but wonder why everyone is so put out about that.? So again, why is that? I ask questions to gain greater understanding but get no tangible answers. ? Okay, watch?2000 Mules.? I've seen it, and I assure you, there is no sermonizing, smearing or campaigning.? It's just raw, factual data.? The film allows you to draw your own conclusions.? If you really are that open-minded, why wouldn't you view it and review the facts you claim you want?

"Absolutely true", you sure of that??? While the Texas Corporation code that was cited in the article does say that loans to a director are prohibited: Sec. 22.225. LOAN TO DIRECTOR PROHIBITED. (a) A corporation may not make a loan to a director. I see no reference to a loan from a director as being prohibited.? And the 2019 Tax Return clearly shows that the $113K+ loan you mention is from an "officer, director" not to an "officer, director". The author of that article made either a huge mistake or is intentionally misleading their readers.? If the latter is true, I wonder how many other misleading statements are in that propaganda...I mean article. |
