We weren’t talking about part 95 (GMRS, FRS, MURS, CB), only public safety and commercial. I do agree neither ham radios or public safety radios can be used on Part 95. Because Part 95 radios are not programmable, those radios cannot be used on ham or public safety, even during emergencies. I am not aware of any Part 95 radios that can be used for ham. Public safety, yes.?

As mentioned earlier there radios that are part 95 approved which can be used by amateurs.
