I think both of our arguments are correct. However your argument showing the the 1 voltage level is out of spec is a more compelling yes or no argument than mine with more technical details to fret about.
For non critical applications my past defenses of the 3.3v without level shifters may have been based on the voltage vs temperature curves. Although I think I've seen a data sheet (maybe an older one) that showed the voltage a bit lower. This in a critical application and your showing the spec in not even met is the best argument for the level shifters.
