I currently live in Gilbert and CC&R from my HOA (City Property) prohibits the installation of any Ham radio antennas, which I'm bypassing by hiding them in a flag pole, (Which can't be higher than the tallest structure approved in my house) and behind walls so they are not visible from the outside. Please excuse me if I¡¯m wrong. It is my limited knowledge of the act than HOA¡¯s cannot prohibit amateur radio antennas.? I know they can have rules¡. I think this was a landmark case back in the 90¡¯s when Dish and Direct satellite dishes were just becoming popular.? I think in this case the HOA couldn¡¯t prohibit satellite dishes. It ?is my understanding that this was the beginning of HOA¡¯s being sued for various HOA violations. I also know there are Law Offices that take on HOA cases that address the installing antennas. I agree on FAA rules and regulations¡. But there may be ways to erect certain antennas that an HOA cannot prohibit.? ? Vince, First I would look into FAA regulations on tower height if on the Pegasus airport flight path.? (I don't expect a problem with a 25 foot tower but if its 100 feet tall a mike from the runway, i think that's a problem
Second, where I live in San Tan Valley you are not permitted to have a visible antenna, even flag poles are regulated.
I believe all HOAs(wgere you pay a monthly resudent fee) have antenna restrictions.
Last, if all is good, tower sntennas, as you can imagine need a poured concrete base and it is proportional to heught and tower style.? The mfg. of antenna should have base of antenna support plans.
