FEDEX Romania ask me abt. usd 2170 custom duties for import of a single QDX

On 26 May I was notified by FEDEX that my QDX is in custom.
They asked?me a lot of papers for custom formalities
- my passport;
-copy of the order
- the proof that I payed the product
- a declaration from my part
After I sent them all required, they asked me to pay custom duties and commission of FEDEX
On 30 May I received a payment request of 117 RON representing custom duties and commissions.

On 4th of June FEDEX sent me a new invoice by ordinary mail for the amount of 10282 RON (about USD2170) for the same consignment.
I have sent them email, phone calls but nothing solved. They say they will analyze it and will reply after 10 days.
In the meantime the invoice states that I have to pay penalties if I do not pay the invoice in due time!!!!!!
I will never ever in my life will work with this company.
I attach the invoice received!

Unbelievable, Corneliu!
I have twice refused UK handling charges etc for parts from the US,
so they were destroyed - or otherwise disposed of.? But nothing
comparable to? the scale of your invoice!

Can you stil refuse acceptance, or would you still be liable??

Can Hans help in anyway?

Corneliu

(my Condolences ... read and guess why)

Looking at the numbers. I'd guess that "VT" or VAT Type? is declared wrongly (if I am correct) Romania has a max VAT of 19%? ...)
May well be that DT = Duties Type is wrong ... (Typo?) (...you are eu and lot's of people have different data already)

PENALTY? Most countries I know will have a pay date (due date) for taxes. Often 2weeks (1+ day) after finalization (NOT declaration by 3rd party).
Seems 15 days in also correct for Romania ... but THIS IS THE TAX OFFICE ... so maybe let them contact you directly for a rather smaller "penalty" and PROTEST!

In any case ALL THIS only applies IF you accept goods imported into Romania and take ownership.
If all else fails (you are consignee _not_ owner for tax purposes) Nilgun Summers (Hans's wife?) is consigner, hast most likely via contract paid TRA n= Transport already)

All the rest is (TNT <ahem>) Fedex "FCK-up"

If push comes to shove ...(fck Fedex/TNT !)... accept an impending "offer" of destruction by local tax office/Fedex in the process of you denying acceptance (and import into ROM)
... I am sure Hans (&Nigun) will be happy to find a much cheaper solution. (What a waste!)

IANAL ... I am not a lawyer...or in any way suggesting something to be done.??

I myself would only ACCEPT OWNERSHIP (and liability for resulting taxes) if correctly billed.

You should do what you decide.

73 and all the best
Reinhold

Dear Corneliu

There is clearly simply a mistake somewhere. I do not think you need to worry about penalties for non payment of what is clearly an utterly unreasonable amount that is due to a simple error somewhere. So simply wait for the outcome of the investigation. Meanwhile I have forwarded this erroneous invoice to our FedEx account representative to see if he can assist from this end.

Document seems legit, so blatant scam and impersonation is probably not the case (not unheard of).
However that amount is ridiculous even for FedEx, it is probably a mistake with a missing comma or other separator.

I had FedEx representative (a broker company between FedEx and customer - me) try to overcharge me 50 euro for similar product (RSP receiver) and I had them ship it back.
But even those (legal) scammers never go beyond 60 euro or so for made up expenses.

Just keep cool and complain (in written or at least email) to everybody even remotely connected to the issue. Best of luck!

Dear Hans
I have sent you in a private mail all the documents regarding this problem
and kindly ask you to clarify with your FEDEX agent the problem.
More over, FEDEX which issued the invoice is located in the UK so you can discuss directly.

Oh dear!
Fedex are well known for not always taking enough time to read and check ALL the documents accompanying a package, in explanation I have earlier heard them apologise.
And in their defence they do get an awful, overwhelming lot of, what is to most of us weird stuff, to process and assess for VAT.

As Hans writes, stay calm, stay objective in your correspondance, and protest, protest, protest.

Read your local regulations to find where these people might have gone wrong, and protest. Be aware the short time limits are there to pressure youinto a quick resolution, protest!
Look for errors in the processing and point these out to the people involved.

As I remember, in (most) of the EU, kits for amateur radio usage are customs duty exempted. one only has to pay VAT or IVA plus a reasonable surcharge to cover clerical costs. For Norway this about Euro14-15.? (shudder).

I'm afraid I am no longer directly involved in working with importing and exporting 'weird stuff' so I can't be more specific than this.

Good Luck

And there is me thinking that the EU was all a group of friendly nations working
cooperatively ;-)

For information only !
After a month of fighting with TNT / FEDEX, I managed to obtain from them a credit note (attached)
to cancel the fraudulent invoice of 2170 USD for the transport and customs formalities of a single QDX.
It seems that the mistake originates from TNT in the Czech Republic.

Hello Corneliu

Thank you for the update and the good news. Very nice. I am of course still saddened by the whole negative experience and I really hope that you can enjoy your radio, despite the bad shipping issues.?

TNT is not funny. I received their Invoice 3 month later for my QCX 160 and they added € 78 freight charges to calculate the VAT. I Asked where that figure comes from but no reply so far. They don't seem to care that the freighr is paid already. Anyhow it was € 21,00 in total so I paid it .

Hello Martin

I posted previously, we have removed the TNT shipping option for Germany and Austria due to these problems; I am researching alternatives to TNT, and meanwhile the post office airmail is quite efficient to Germany and Austria, so it seems.?
