Fiji Law Reform Commission: EOI - appointment of FLRC Part-Time Commissioner: Review of High Court and Magistrate's Court Rules: 2025/79
Pacific Vacancies Announcement No. 2025/79 PLEASE NOTE THE SHORT APPLICATION DEADLINE OF 18 FEBRUARY 2025 ------------------------------------------------------------------------------------------------------------------ ? ? Expression of Interest for the Appointment of FLRC Part-Time Commissioner under Section 3(2)(b) and 3(6) of the FLRC Act. Review of the High Court Rules 1988 and the Magistrate’s Court Rules 1945 ? The Fiji Law Reform Commission established under the Fiji Law Reform Commission Act 1979 (“the Act”) and entrusted to undertake the systemic review, reform and development of the laws of Fiji, invites expressions of interest from individuals or project teams that wish to undertake the Review of the High Court Rules 1988 and the Magistrate’s Court Rules 1945 (“the Civil Rules”) in accordance with Section 3(6) of the Act. ? The holistic Review was authorized by Cabinet on the 4th of July, 2023. In furtherance of the Fiji Law Reform’s Work Programme 2024-2025, the FLRC will be implementing this Review in collaboration with the Civil Division Rules Committee of the Judicial Department of Fiji. ? Objective ? The objective is to review the Civil Court Rules in a holistic manner to attune them to modern case management philosophy and to modernize civil court practice and procedures for efficient and effective litigation of civil matters that is suitable to Fiji’s current and future needs and circumstances. ? It is envisioned that the proposals for reforms emanating from the review will provide Fiji with comprehensively revised and modernized Civil Court Rules and will include proposed legislative amendments to the High Court Act 1875, Magistrate’s Court Act 1944 and any other consequential legislation that may need to be amended to achieve the holistic reforms needed. ? Scope of Work ? This includes: a)?? undertaking comprehensive research on existing Civil High Court Rules and Magistrate Court Civil rules and proposing changes (inclusive of considering the? Judicial Civil Review Committee’s Report of? June 2024 on recommended changes); b)?? analyzing data, trends, and outcomes related to civil litigation and procedural efficiencies; c)?? reviewing appropriate and relevant case law and statutory updates affecting civil procedure across various? Commonwealth Jurisdictions; d)?? drafting official documents including meeting minutes, guidelines, and public announcements; e)?? maintaining detailed records of Committee meetings, discussions, and decisions; f)???? Preparing and drafting of Discussion tools such as an Issues paper and/or Discussion paper and related materials for dissemination prior to public consultations; g)?? facilitation of consultations with the public and targeted stakeholders via participatory workshops, seminars, or discussion forums; h)?? preparing drafting instructions and assisting in the drafting of new regulations, Rules, bills, and Cabinet papers; i)???? ensuring proposed Rules align with ethical standards and legal requirements; j)???? delivering presentations to Committees both internal and external on research findings and recommendations; and k)?? preparing reports and presentations to summarize findings and suggested recommendation for reform. ? In furtherance of the above, the Part Time Commissioner(s) will also be assisted by FLRC personnel and have access to FLRC resources and office facilities, during the course of this time. ? ? An Expression of Interest (‘EOI’) must be accompanied with the following: 1)?? Background information of the Part Time Commissioner(s) to be appointed under the Act including relevant qualifications in law and or requisite experience attained; 2)?? Methodology to be adopted in undertaking the review; 3)?? Proposed Work plan including projected timelines and deliverables; and 4)?? Estimate of overall charges and fees. ? Requirements ? Preference will be given to persons who have: ? 1)?? Completed a Degree in Law or a related field from an accredited university or equivalent relevant experience, and have the following knowledge, experience, skills and abilities required to successfully undertake this role individually or as Part of a Team; ? a)?? holds, or has held a high judicial office in Fiji (High Court above) or in another country prescribed by law or has had not less than 15 years post-admission practice as a legal practitioner in Fiji or in another country prescribed by law, and has not been found guilty of any disciplinary proceeding involving legal practitioners whether in Fiji or abroad, including any proceeding by the Independent Legal Services Commission or any proceeding under the law governing legal practitioners, barristers and solicitors prior to the establishment of the Independent Legal Services Commission; b)?? A strong understanding of civil procedure and litigation processes; c)?? Excellent research, analytical, and problem-solving skills; d)?? Effective communication and interpersonal skills for stakeholder engagement; e)?? Proficiency in drafting reports and official documents; and f)???? Ability to work collaboratively with a Committee, or a Technical Working Group and manage multiple tasks effectively, ? ?The successful applicant(s) will be required to: 1.?? work within stipulated timeframes under an agreed “Work Plan”; 2.?? provide regular progress reports to the Working Committee Chair, Chief Justice, Director FLRC and any other required persons to keep abreast of the progress; 3.?? sign an Agreement with the Fiji Law Reform Commission. ?
