Obviously, the requirement that one be certain of the accuracy of his information applies to all situations where loshon hora or rechilus is to be spoken for a constructive purpose. There is, however, an aspect of this requirement that does not apply in all cases.

We have seen (Days 52-54) that the Torah requires us to judge our fellow Jew favorably and refrain from concluding that he has sinned when an alternative way of explaining his behavior can be found. As noted, even when it is clear that the person has sinned, one must consider the possibility that this may have been the result of ignorance or unusual circumstances.
?
While the Torah does insist that we give people the benefit of the doubt, this should not be done at the expense of others. Consequently, if one has witnessed one person harming or attempting to harm another, the need for accuracy does not require an attempt at justifying the perpetrator¡¯s motives. Even if the act is out of character it must be rectified, and one may, therefore, inform the appropriate parties.

Two Failures

I passed by the field of a lazy man, and by the vineyard of a man devoid of understanding, and lo! It had become overgrown with thorns, briars had covered it over, and its stone fence had been destroyed. I perceived this and considered it well, I looked upon it and took from it a lesson (Mishlei 24:32-33).
?
These verses describe two individuals who took divergent paths, both ending in failure. I passed by the field of a lazy man ¡ª a man whose laziness caused him to neglect the study of Torah, or to forget what he had already learned. The owner of the vineyard was a man devoid of understanding ¡ª a foolish man who did not take care to hold on to those mitzvos which he had accomplished through much time and effort. The first man, instead of planting seeds of spiritual attainment, allowed his field to become overgrown with thorns, the thorns of idle chatter and fruitless endeavors. As for the second man, the sacred words of Torah study and prayer which he had uttered with fervor and devotion, which could have ascended Heavenward as a song of praise to the One Above, had become unrecognizable ¡ª briars had covered it over ¡ª the briars of spiritual impurity wrought by evil speech.

Day 150 ¨C Secondhand Information: A Distinction
?
We have seen (Day 140) that secondhand information which would ordinarily be considered rechilus may be communicated for a constructive purpose provided that it is not presented as fact. Regarding loshon hora, however, communicating secondhand information for a constructive purpose was prohibited in most cases (see Day 43).
?
The Chofetz Chaim explains that while achieving a positive result on the basis of firsthand information is justified even when the chances for success are minimal, secondhand information may be used only when one can assume that the intended result will almost certainly be achieved. Consequently, one may inform one party in a prospective shidduch (marriage match) or business partnership of possible major problems regarding the other party (see Day 83) on the basis of hearsay, since such information will probably be taken very seriously. For the same reason, one may warn a potential victim of impending danger on the basis of secondhand information.

Conversely, one cannot publicize the alleged unethical behavior of an individual with the hope that social pressure will encourage him to change his ways or reimburse his victims; this would be permissible only when one has witness to such behavior. The effectiveness of social pressure in persuading people to change their ways is far too limited to justify relating secondhand negative information ¨C even if it is clearly stated that the information has not been verified.

Squandering One¡¯s Wealth

?
In the Book of Mishlei (Proverbs), we read, ¡°There is one who is [apparently] rich, but [in truth] has nothing¡± (Mishlei 13:7). To understand this proverb, let us imagine that a person has made business investments which earned him huge profits. To everyone, including himself, the man seems on his way to achieving great wealth. Later, however, the man makes a thorough accounting of all his endeavors and discovers that, to his dismay, the losses of certain investments all but nullified the huge profits that other investments had earned for him. There is one who is apparently rich, but in truth has nothing.
?
The lesson is clear: A person can spend a lifetime accruing merit through the performance of mitzvos and the study of Torah. Yet he can come to the Next World and find that his merits have been nullified by his negative attitude towards others. The bounty of spiritual reward that had been awaiting him was washed away by the waves of scorn, slander and strife which poured forth from his lips.

There is that panic-attack level of urgency to just solve this problem already. You want to catch it double-quick, because...


If it¡¯s hard for them to learn, then they don¡¯t enjoy it.


If they don¡¯t enjoy it, they don¡¯t want to learn.


Then you are left with a kid in the school system who doesn¡¯t want to learn.?


That means trouble.


How much time do you have to play with before they start looking outside the warm, safe walls of their classroom for¡­ other options?


Devorah (not her real name) was plagued by all of these worries.?


Her son, age 11, was in 5th grade.?


He couldn¡¯t read.?


He could pronounce the sounds of the nekudos. He could recognize the letters. But his kriah skills were basically non-existent.


General disability testing produced a diagnosis of dyslexia and a number of other reading and learning impediments.?


Repeating a grade wasn¡¯t any help. He was still behind academically. And now that his class was poised to begin learning Gemara, Devorah was nail-biting.?


She knew deep down that sitting with a Rebbi and repeating ¡°kamatz aleph - ah¡± was not what her son needed.


He needed something that would identify the issues with his brain function ¡ª whatever they might be ¡ª and solve them.


Did that kind of thing even exist??


And could it produce results quickly enough? Before her son¡¯s peers began to learn Gemara and he found himself¡­ an outsider?


It was around then that an ad caught her eye. It discussed a revolutionary reading method named the ¡°Zobin Method.¡±

A Study in Contrasts
?
In summation: A Jew must strive to develop positive character traits, especially with regard to traits that have a major impact on interpersonal relationships. One must strive to assist his fellow to the best of his ability and overlook his fellow¡¯s faults just as he would want others to overlook his own faults. If one¡¯s friend has expressed his anger toward someone else, he should do his best to soothe that anger through reason and explanation ¡ª a demonstration of true wisdom and inner strength.
?
A wicked person behaves in the very opposite way. He seeks to damage others, to reveal their unintentional misdeeds and claim that they were committed willfully. The wicked person rejoices over another¡¯s failings, and incites others to feud. He prides himself over his success in such endeavors, as he considers this an indication of his wisdom and might ¡ª but of course he is wrong.
?
Midrash Shochar Tov (ch. 52) cites the episode of Doeg¡¯s treachery against David and Achimelech, the Kohen Gadol (High Priest). At a time when King Shaul was in pursuit of David and seeking to harm him, Doeg told Shaul that Achimelech had intentionally helped David to flee from Shaul, which was a lie. Doeg¡¯s slander brought about Achimelech¡¯s death (see I Shmuel chs. 21-22).

As the Midrash relates, David told Doeg, ¡°Is a man truly mighty when he sees his fellow at the edge of a pit and pushes him in, when he sees his fellow on top of a roof and pushes him off? On the contrary, a man deserves to be called a mighty warrior when his fellow is about to fall into a pit and he grasps his hand to prevent his fall or when he lifts the fallen man from the pit. But when you saw that Shaul was angry at me, you persisted in vilifying me.¡¯¡¯ Thus did David say, ¡°Why do you pride yourself with evil, O mighty warrior?¡¯¡¯ (Tehillim 52:3).
