Day 11 ¨C Common Knowledge

?
?
A derogatory statement is considered loshon hora even when the information is common knowledge for, as stated above, to speak negatively of one¡¯s fellow Jew is shameful in itself.
?
Negative information about Jews appearing in newspapers may not be repeated.? Newspapers often publish articles based on hearsay and thus, one is not even permitted to believe such information if the newspaper is its only source.? Even after one has verified the information, he may nevertheless not repeat it.
?
?

?
SEFER SHMIRAS HALOSHON

?
Equal to All
?
Talmud Yerushalmi (Pe¡¯ah 1:1) states that the reward for studying Torah is equivalent to that of all other mitzvos combined, and the punishment for speaking loshon hora is equivalent to that of all other sins combined. Thus, the antithesis of Torah study, the greatest of all mitzvos, is loshon hora. Their respective primacy can be explained as follows:
?
Of the four basic elements of nature ¡ªfire, wind, water and earth ¡ªthe intangible (fire and wind) are far more powerful than the tangible (water and earth). Fire can engulf material objects and totally destroy them, and the power of wind is awesome, as it is written, ¡°A great and mighty wind which breaks apart mountains and shatters stones¡± (I Melachim 19:11).
?
The same is true in the spiritual realm. Torah study impacts in the Upper Worlds in a way that no other mitzvah can. This is because all other mitzvos are related to the physical ¡ª for example, to fulfill the mitzvah of tzitzis, one dons a garment, a material object; a lulav is held, a physical act; a shofar must be blown, etc. Torah study, however, is performed through the power of speech, which, essentially, is a function of the soul.1 This is why the reward of Torah study is equivalent to that of all other mitzvos combined.
?
The converse is true of sin. The spiritual damage caused by loshon hora is infinitely greater than that caused by other transgressions, because it is committed through the power of speech. Its effect in the Upper Spheres is awesome. Therefore, its punishment is equivalent to that of all other sins combined.
?
?

1. As mentioned above, Targum Onkelos translates ¡°and man became a living being¡±
(Bereishis 2:7), as ¡°and man became a speaking spirit.¡±

?
Day 12 ¨C Ambiguous Statements
?
?
A Jew is responsible for exercising caution in speech and not making statements which can be misinterpreted as being derogatory.
?
An example of an ambiguous statement that should not be said is: ¡°He¡¯s a well-meaning fellow,¡± which can mean, ¡°He¡¯s well-meaning but not very intelligent, or, ¡°He¡¯s well-meaning but his actions are wrong.¡± If one simply means, ¡°He¡¯s well-meaning and sincere,¡± then this should be made clear.
?

SEFER SHMIRAS HALOSHON
?
Measure for Measure
?
The way in which one acts towards others determines the way in which Heaven will act towards him. For example, if one strives to overlook the hurt caused him, and if he acts towards others with kindness and compassion, then he awakens the Attribute of Compassion in Heaven. Hashem will judge him with mercy and he will be shown kindness from Above. As our Sages state: ¡°Whoever has compassion towards others will be shown compassion from Above¡± (Shabbos 151b); and ¡°Whoever refrains from exacting his measure [of retribution from others for the wrong they caused him] will have all his sins forgiven¡± (Rosh Hashanah 17a). Moreover, in his merit, Divine compassion will manifest itself upon the Jewish nation as a whole.
?
However, if it is one¡¯s way to be absolutely unrelenting towards others and to treat them without compassion, then he lends strength to the Attribute of Justice ¡ªtoward himself specifically, and to the entire Jewish nation as well. Heaven will be unrelenting regarding that person¡¯s sins, for ¡°With the measure that a person measures do they [i.e. Heaven] measure him¡± (Megillah 12b).
?
Our Sages state: ¡°Jerusalem was destroyed only because its inhabitants limited their decisions to the [letter of the] law of Torah¡± (Bava Metzia 30b). This seems difficult, for Scripture records many sins of which that generation was guilty. Our discussion sheds light on the matter. Had the people overlooked the wrong caused them, then Hashem would have forgiven them as well. However, they were absolutely unrelenting toward each other, demanding from one another whatever they could possibly extract according to the law ¡ªand Heaven judged them accordingly.

The Season of Our Joy

The Kotzker Rabbi said that joyfulness is the outcome of holiness. Therefore, Sukkoth, coming after Yom Kippur when we become holy and sinless, is called "the season of our joy."

Adapting our Services

Said the Medibozer: "During the Holidays of Tishrei we serve the Lord wiht our entire body. On Rosh Hashanah our service is with our brain, since memorial is within the mind; on Yom Kippur, wiht our heart, since fasting weakens the heart most; on Sukkoth with out hands, since we hold the lulav; on Simchath Torah, with our feet, since it is customary then to? dance and march."

Teshuva from Halacha For Today

¿ªÔÆÌåÓý

?
?
CURRENT TOPIC:
Review of Halachos of Yamim Noraim
1) The Aseres Yemei Teshuva, and particularly Erev Yom Kippur, is the ideal time to apologize, beg forgiveness and ask for Mechila from anyone that we may have slighted in any way throughout the previous year?(or longer).
?
Sins that require Mechila from another human being will not be wiped away with Teshuva alone, until forgiveness is sought. If one asks you for Mechila, you should find it in your heart to forgive them.?(Mateh Ephraim Siman 606:1)
?
The Poskim say that if the one who wronged you does not come to you to ask for Mechila, then you?(the victim)?should go to him/her and present yourself to him/her in such a way to encourage them to ask you for forgiveness?(Mateh Ephraim Siman 606:3 based on Talmud in Yoma 87a).?The Seforim compare this to us and Hashem. In the Yemei HaTeshuva Hashem comes down from Shamayim and makes it easy for us to ask - and receive - His divine forgiveness, as it says in the Posuk?"Dirshu Hashem B'HiMatzo - Seek out Hashem when He is near".
?
Asking Mechila in a general way (e.g. "Are you Mochel way for anything and everything I may have done etc.) is sufficient for minor infractions only. However if you wronged someone in a significantly harmful way?(spoke scandalous Lashon Hara or Motzi Shem Ra about them, caused them significant monetary damage etc.)?you must beg their forgiveness specifically for that infraction, and must verbalize the details upon asking.?(Mateh Ephraim Siman 606:2)
?
If you spoke Lashon Hara about somebody and they don't know about it, and by revealing it to them (in order to ask forgiveness) you will cause them additional pain and anguish , it is a dispute amongst the Poskim as to the best course of action.
?
Rav Yisroel Salanter Zatzal maintained that if by going over to the person who you spoke against to ask for mechilah will cause them further harm, it is best not to let them know, and try to do as much Teshuva as possible, and try to spread good about that person in other ways.?(Rav Shlomo Zalmen Auerbach Zatzal ruled according to this opinion)
?
The Chofetz Chaim Zatzal?(Hilchos Lashon Hara Klal 4:12)?ruled that Teshuva was only complete with mechila, and even if it caused further harm, you must approach them.?For Halacha L'Ma'aseh, of course, a Rav must be consulted.
?
It goes without saying that when asking for forgiveness it must be sincere and you must genuinely regret what you did and resolve not to do it again. Simply mouthing the words "Are you Mochel me?" isn't sufficient. Likewise, the one who says "I am Mochel you" but doesn't really mean it, and continues to bear a grudge in his heart, is doing a disservice for all parties involved.
?
2) When forgiving someone, it is extremely important to verbalize this fact by saying "I am Mochel you with my whole heart".?(See Rabbeinu Bechaya Bereishis 50:17 where explains that Yosef HaTzadik was Mochel his brothers, the Shevatim , in his heart, but never verbalized this thought, thus the Asara Harugei Malchus and many other Tzaros needed to befall Klal Yisroel over the ages. There is a lengthy discussion about this, but this forum is not the place)
?
After receiving forgiveness from the people that we hurt, there are still 24 things?(Brought by Rabbeinu Yonah in Sharei Teshuva, end of Sha'ar 1. They can also be found more at length in the Rambam Perek 4 of Hilchos Teshuva. The original source for this seems to be a Tosefta)?that are Me'Akev - prevent - proper Teshuva from being attained.
?
Obviously it is best to try and make sure that we don't have any of these impediments in our day to day lives, so we can assure that our Teshuva is easily attained and properly accepted by Hashem.?Most of these things are probably not relevant to most of the people reading this, but it is still Halacha, and can be used as a catalyst for Teshuva in other areas in which we may indeed need rectification.?
?
The 24 obstacles to Teshuva are:?(Loose translation. It would be too lengthy for this forum to delve into the details of each one)?
?
1.??????One who frequently spreads Rechilus (slanderer)
2.??????One who regularly speaks Lashon Hara (Gossiper)
3.??????One who gets angry quickly
4.??????One whose bad (impure) thoughts control him
5.??????Being connected to a rasha (evildoer)
6.??????Taking from food that isn't sufficient for its owner
7.??????Gazing at Arayos with sinful intent
8.??????Partnering with a thief
9.??????One who says "I will sin and repent afterwards" or " I will sin and Yom Kippur will atone for the sin"
10.??One who derives honor [and pleasure] from his fellow man's humiliation.
11.??One who separates him/herself from the Tzibbur (congregation).
12.??One who ridicules his forefathers and/or teachers
13.??One who curses the public
14.??One who prevents a group of people from doing a Mitzvah
15.??One who causes another Jew to leave the good path and take a bad path [of living not according to the Torah]
16.??One who uses the pillow of a poor person [i.e. causes a poor person to lose the use of any of his meager possessions]
17.??One who accepts bribes in order to skew and distort justice from prevailing.
18.??One who finds a lost object and doesn't [try and] return it to its proper owner.
19.??One who sees their child going off the [Torah] path, and doesn't admonish them.
20.??One who eats [i.e. usurps] the food [i.e. livelihood] of poor people, orphans or widows.
21.??One who argues [and does an action] against the will of the sages.
22.??One who accuses good people of doing wrong [without proper proof or reason]
23.??One who hates [and cannot accept constructive] criticism.
24.??One who ridicules all or some of the Mitzvos of the Torah [or those instituted by the sages]

Reader's Question:

?Is the night before Yom Kippur also considered Erev Yom Kippur? And if it is, is it therefore considered a mitzvah to eat more?

Answer:

?It is Erev Yom Kippur.

However, according to most Poskim the Mitzvah to eat begins at daybreak. (See Biur HaGra to Siman 604, Magen Avrohom Siman 604 and He¡¯emek sh¡¯eilah from the Netziv Parshas V¡¯Zos HaBracha Siman 169:1)

Some Poskim say that the Mitzvah already begins at Shkiah of the eve of Erev Yom Kippur, but even they agree that the main Mitzvah is by day. (See Bach Siman 604)

Foreign Substance'

Day 7 ¨C Matters of Taste

?
It would seem that there is nothing derogatory about a statement of taste.? To say, ¡°I don¡¯t like dry wine,¡± is a description of the speaker¡¯s preferences and not a critical evaluation of the wine.
?
Ostensibly, then, one should be allowed to say that one does not like the oratory style of a given lecturer.? In fact, however, such statements are generally prohibited, for they imply that the speaker lacks effectiveness.
?
SEFER SHMIRAS HALOSHON
?
Breaking Bad Habits
?
?
In truth, there is no basis for the contention that the average person cannot avoid forbidden speech for more than a day or two. It is a proven fact that the longer one persists in guarding his tongue, the easier it becomes.
?
To gossip is a habit, and habits, as time goes on, become a part of a person¡¯s nature. But bad habits can be broken, especially when one becomes aware that a given habit involves numerous Torah prohibitions and is described by our Sages in most severe terms. Such an awareness, coupled with a bit of zealousness, goes a long way. One who would speak whatever came to mind without a moment¡¯s hesitation, will now find himself weighing his words before expressing them.
?
One should not grow frustrated if, after he resolved to avoid forbidden speech, his evil inclination got the better of him and he spoke loshon hora. Even if this happens time and again, nevertheless, he should not despair. Rather, he should forever strengthen himself to avoid improper speech, and persevere. This is how one should conduct himself his entire life.
?
This is the intent of the Talmud¡¯s statement, ¡°One should forever arouse his good inclination to subdue his evil inclination¡± (Berachos 5a). Life is an ongoing struggle with one¡¯s evil inclination. One must forever be poised for battle and never be discouraged by failure. With knowledge of what the Torah requires of us and proper resolve, our efforts will ultimately succeed.

The Firghtened Fox

Said the Besht: "The lion became enraged at his subjects, the animals of the forest. They asked the fox to placate the King of Beasts by relating to him an appropirate fable. The fox replied, however, that fear had caused him to forget his fables. Hence the beasts were compelled to wait on the lion themsleves.
"In the same fashion, on the Awesome Days, the people of the congregation should not depend upon their rabbi to pray on their behalf. Each one should do so by and for himself."

?
?
?
Previously, we saw that a statement which is essentially derogatory is forbidden, regardless of the speaker¡¯s opinion regarding that statement.? Conversely, it is forbidden to utter a statement which, essentially, is not derogatory, if either the speaker or the listener considers it derogatory.
?
An illustration of this would be where an individual¡¯s mode of dress is being discussed.? Although there may be nothing wrong with the way the person dresses, nevertheless, it is forbidden to say that the individual dresses in that manner, if either the speaker or listener has an unfavorable impression of those who dress that way.
?
?
?

SEFER SHMIRAS HALOSHON
?
Beyond Comprehension

?
Let us address the contention that it is virtually impossible to faithfully observe the laws of shmiras haloshon for more than a day or two:
?
Even if this were correct, is it reason enough to ignore this mitzvah? Imagine a person walking along the seashore, who sees that the sea has washed ashore precious gems. Would such a person ¡ª even if he were wealthy ¡ª refrain from picking up any gems because he knows it will be impossible to gather them all?
?
It is exactly the same regarding shmiras haloshon. It is well known that the Vilna Gaon (in his famous letter) quotes the Midrash which says that for each moment in which a person refrains from speaking the forbidden, he merits a hidden light that no angel can fathom. Note that the Midrash does not speak of refraining from forbidden speech for a month, a week, or an hour ¡ª but for only a moment!
?
Scripture states: ¡°If you will seek it like silver and hunt for it like hidden treasures, then you will understand the fear of Hashem, and knowledge of God you will find¡± (Mishlei 2:4-5). One must strive to attain spiritual goals in the way that he would seek the greatest valuables that this world has to offer. This is the intent of the statement, ¡°Do not distance yourself from a quality that is without limit.¡± Avoiding forbidden speech brings infinite merit; if we will only pursue this quality, and not tell ourselves that it is out of our reach, then we will have achieved that which no angel can fathom.
