I can’t answer that question. If the publisher has gone out of business, then it is whoever bought the assets. If nobody did that, then the copyright reverts to the author he may be doing nothing with it, or he may have assigned the rights to another publisher. If he is no longer living, then it goes to his heirs or other designee. There are a number of works out there that are still in copyright, but nobody has any idea who has the rights. The situation with Google Books is an example of this situation, which is still in litigation last I heard.
