MODERATOR'S RESPONSE TO COPYRIGHT INFRINGEMENT
cprdb
REFERENCE: This topic, while perhaps about a CPR publication, is outside the scope of the list. Thanks - Bill Miller <bmiller@...>
I was hoping this discussion would be allowed to continue a while longer and not be nipped in the bud quite so quickly. The publication of data and information is fundamental to the hobby of railfanning and model railroading. Even more so now with the instant communication provided by the Internet. I was wondering how list members feel on the subject of copyright regarding this list and the railway web sites currently online? Bryce Lee has been publishing on the Internet for quite some time. I would like to hear his public opinion regarding Internet copyright. In the preceding discussion the outcome seems quite clear. Roger is an author who expects to be paid for his creative effort and must protect his copyright which has obviously been infringed. Recompense is obviously due. But what about information contained in this list? If I take something and publish it for profit am I stealing the Poster's copyright? If I publish a photograph from someone's personal website am I stealing their copyright? My feeling is anything you may publish on the Internet, unless on a secure server with restrictive password entry, is in the "Public Domain". This includes this list. This would therefore leave me free to quote what and where I like, with or without credit. Etiquette and prudence suggest I ask forgiveness from the author in advance, but I don't believe it is necessary. The Author may then feel ripped off but what is his/her damages? If you publish to this list, the web, or the internet, you place a value of zero on your efforts because you gave it away freely. How could you claim damages in a court of law? Therefore, the Internet, particularly this list, is primarily about the FREE sharing of information. If someone uses your utterances I don't believe as the author or photographer you have any recourse. I guess where I'm going with this is how do we obtain quality online railfan/modeller publications? How do the Author's or contributors get recognized and paid for their efforts? Bryce Lee's "Canada Calling" is an example of excellent work no longer available. Do we want it this way? SLiM - cprdb@... Visit Victoria! |

I was very recently at a little wreck down around here and I brought my camera. It was my intention to post the pictures and the details. I was in the company of the pertinent CP official who asserted that these pictures and details are not advisably published on the website. Under his advise, I will not. No less than a day later, I wished to respond to a pertinent posting on this list about the very nature of this medium, the freedom of information. I will not. I feel that the internet itself has begun to be constrained and seriously compromised by the interference of the self righteous 'newbies' who might dictate its use like they own it and can somehow wield influence upon me as to how I may use it to disperse knowledge and information for its own purpose and not for profit. I apoligise in advance, for thinking that this list is not only for modelmakers, and to not intend to enflame. ( Come to think of it, I do have an extensive 'n' scale set myself ) Personally, I feel that the subject of copyright was innocently enough introduced, and the responses were not at all repulsive. Although not on topic, not nearly as abusive or violative as the response from listmember Young who shouted DELETE!, DELETE!, DELETE!, DELETE! WHO CARES, NOT AN APPLICABLE TOPIC! DELETE!, DELETE!, DELETE!, DELETE! Perhaps I missed the humour sir, but I think you should apologise to those you have attacked here. If , in fact I have missed the humour; then DELETE DELETE DELETE! cheers Paul Bellis Canadian Pacific Railway Toronto |

Congratulations to Paul Bellis for his response to this topic, and I
heartily agree with him that Mr Young's response was not only abusive, but showed a lack of class as well. Secondly, I believe the original topic was within the guidelines of this list as it pertained to an article about the CPR at Kettle Valley and a likely infringement of copyright. As a person that is thinking seriously about writing articles for both the CPR SIG and CNR SIG magazines, I was interested in how the copyright issue was perceived, what exactly a copyright infringement is, and how it might affect me in writing any future articles on the CPR or CNR. At least it wasn't another ad nausium posting about where a particular locomotive is / was / is going to be. There's an item that I believe is worth deleting and I do just that without sharing my view by shoutind DELETE!, DELETE!, DELETE!, DELETE! Even though we share an interest in the CPR, we all have different areas of interest, and we should at least be tolerant of those on the list, no matter how we personally feel about them. Mike Salfi a person who likes discussing topics on the CPR as to how they pertain to modeling the CPR. From: jpaulb1@...
