Dear Judith,
The U.S. Environmental Protection Agency has dropped its appeal of our lawsuit victory restoring Clean Water Act protections to the Redwood City Salt Ponds. The move came a week after 57 Bay Area elected officials and organizations upholding those legal protections.
¡°We¡¯re thrilled that the Biden Administration is agreeing to uphold the law and restore protections for San Francisco Bay wetlands. Climate change makes this even more urgent,¡± said Save The Bay Executive Director David Lewis.
¡°It¡¯s an early indication of what a difference the new President can make for the Bay and our planet.¡±?

Save The Bay and other environmental plaintiffs sued Trump¡¯s U.S. EPA in 2019, over its waiver of Clean Water Act jurisdiction on the ponds. The Federal District court ruled in October 2020 that EPA misapplied the Clean Water Act and ignored its own agency regulations, ordering the Agency to provide a legally sound jurisdictional determination. In 2016, EPA Region 9 scientists and legal counsel completed an exhaustive site investigation and legal review, concluding that the vast majority of the site is jurisdictional wetlands under the federal CWA and is protected by that law.
For 15 years, Save The Bay has fought development on these ponds. Now it is time for Cargill to transfer this sensitive site for addition to the San Francisco Bay National Wildlife Refuge. With your help we can achieve permanent protection and restoration of the Redwood City Salt Ponds.

This event will?introduce the Superintendent,?who previously oversaw commercial grazing in Cuyahoga National Park in Ohio, and include?time for?Q&A from the audience.?I encourage you to attend and voice your concerns about?the need to prioritize Tule Elk and the whole ecosystem?at PRNS.
Here are a few talking points you can use to structure your questions and comments to Superintendent Kenkel:
- I believe the National Park Service's key priority should be to protect native plants and wildlife. Culling Tule Elk to satisfy private ranchers?is the opposite.
- The current ranching activity?impedes my ability to enjoy PRNS -- it blocks my access, it mars the landscape and we¡¯ve seen higher levels of e.coli and bacteria in local waterways, far exceeding health regulations, likely as a result from their manure.
- As a national parks lover, I would like?to see?land that is being privately ranched opened, restored and rewilded, as nature intended.
Let's show new Superintendent Craig Kenkel that, despite his experience in Ohio, Point Reyes is different.?Especially in light of the first Native American, Deb Haaland, potentially leading the Department of Interior, our community overwhelmingly supports a return to how Point Reyes existed for hundreds of years before ranchers showed up!?.

Two weeks ago, an oil pipeline at the Chevron refinery in Richmond leaked, spilling more than 700 gallons of diesel mixture into the Bay. Authorities closed Keller Beach and issued a public health advisory. "The whole area smells like a gas station,¡± Baykeeper Executive Director Sejal Choksi-Chugh?said in a KQED interview, ¡°And there's the
possibility of long-term, unknown damage to the Bay itself and to all the wildlife that depend on it." Baykeeper Field Investigator Cole Burchiel?was one of the first people on the scene?with our trusty patrol drone, Osprey. Our drone footage revealed that the oil had?spread out into a wide sheen, beyond Chevron's containment boom.? The area affected by the spill included sensitive eelgrass habitat and an important spawning ground for herring populations. But the spill could have been?much worse. All around the Bay Area, upwards of 1,000 industrial facilities allow polluted runoff to seep into the watershed¡ªa slow drip of toxic waste that turns into a deluge every time it rains. That's why Baykeeper conducts multiple rounds of stormwater sampling every year throughout the rainy season and gathers evidence against the biggest polluters to hold them accountable under the law.? So to expand our sampling capacity, Baykeeper Staff Scientist Ian Wren
conducted a virtual training with staff and experienced volunteers on how to correctly collect and process polluted runoff samples. This allows us to have trained samplers around the Bay to spring into action whenever the moment is right to catch more polluters in the months and years ahead!
