The lawyers at UF, once properly appraised of the NUMBER of volunteers working on this, have an extremely strong liability and legal defense coverage for any volunteers who are ACKNOWLEDGED FORMALLY AS VOLUNTEERS.? ?The University of Florida is not a manufacturing facility; we are a healthcare medical school (Plus liberal arts, etc) -- and your expertise, incorporated into a ventilator, should it be used on patients at our hospital -- you will not onlly have coverage, you would have legal defense, and yoiu cannot even be sued individually? ?THIS is the coveraaage that I *always* had as a physician working for them for 30 years, that ALL their employees have, and that now YOU will enjoy.? I'm working on the menuing system for the code I sent yesterday and I'm making good progress. The code is pretty easy to read and I think anyone will a little C knowledge will be able to change it "in the field" as they need (e.g., translate prompts). I'll send it when I have the menuing system working. Then I'll add the pressure sensor and alarm code.

Gordon - Thanks for the work putting this together.? I appreciate all that you, Dan D'Alesio and everyone else is doing trying to get the legal taken care of.

My concern with the?IEC 60601-1 Compatible design is that the very people we need to help get the design there are the ones that have been the most 'spooked' by the recent legal back and forth.? I'll have some time today to meet with and better understand how the hardware, software and QA volunteers feel about moving forward.??

This is a very positive outcome, and I appreciate greatly Dan D'Alesio (UF Lawyer) who immediately recognized the concern and immediaately found ways to cover these volunters -- and also many of you who have proivately or publicly given me crucial advice to search for this coverage.? ?So I expect to be fully operational again for UF within a couple of hours.

I've been off running errands to work on this....and still have much much more to do.? ?But some of the ideas that some of you have provided are starting to significantly improve the system.? ??

And the TESLA people are basicallly barking up the exact same tree....they just have better valves (probably $$$) and a bunch of paid engineers who have a lot of expertise also.? ?More power to them!!!!!? ?Having multiple people working on it is great.? ?And the docs are working on better treatements --- so a lot of research and private enterprise.??

Just need to remind everyone -- the Universtiy of Florid is NOT a manufactuer, nor an insurance carrier.? ?We do projects for the good of the world, and for the care of our patients and for the creation (normally) of licenseable knowledge.? ?In this case we are giving it away free.? ?Thus our disclaimer has always made it very clear that USE IS AT YOUR PERIL -- so more power to those of you who are manufactuers, but you will need to do your part as a manufacturer.? ?We cannot ditch everything that we have merely because you have an improved method which we could have working in, say, 2-3 weeks......that will be way too late.? ?If you have something, MAKE IT WORK and SUBMIT YOUR EUA.? ?Simple as that, folks.? ?we are GIVING YOU LOTS OF FREE INFO -- you run with it, OK?

Somewhat frustrated by the long delay and lack of information I phoned Dr. Gravenstein to find out what is going on. ?They have all the information ready, and are trying to get into see Dr. Morey for his signature. ??


so we are apparently in a bureaucratic delay.?
people can only do so much I guess.?


I am still hopeful this will happen, but it is frustrating to wait for it. ? I will have rushed printed circuit boards arriving later today, but I cannot deliver them to UF without this protection ¡ªeven if it means I eat the cost of having them made¡ª Which was more than I have paid for quite a few used pactor ?modems!!?

Well, at about 330 this afternoon, 30 minutes ago, I got notice that we are finally approved for the list that we cobbled together of people who wanted to be on the volunteer list. ?They had agreed to 10, I think we might¡¯ve gone over, and I hope they were willing to take the extras, I don¡¯t think they had any clue the vast number of people who were generously giving of their time and talents. ??



these are lawyers we have to deal with, and the one who worked on this appears to be a stellar fellow, but apparently they had to do some background checks and that took some time. ??


but I¡¯m happy to report that things are finally settled and as soon as I have a scan I will share that with you. ? At least it will give you an idea what to request the next time one of these things comes up. ?I also sent them a green, yellow, red coded report of what I saw happening right now and what were the worst impediments. ? ??
