Day 11 ¨C Common Knowledge

?
?
A derogatory statement is considered loshon hora even when the information is common knowledge for, as stated above, to speak negatively of one¡¯s fellow Jew is shameful in itself.
?
Negative information about Jews appearing in newspapers may not be repeated.? Newspapers often publish articles based on hearsay and thus, one is not even permitted to believe such information if the newspaper is its only source.? Even after one has verified the information, he may nevertheless not repeat it.
?
?

?
SEFER SHMIRAS HALOSHON

?
Equal to All
?
Talmud Yerushalmi (Pe¡¯ah 1:1) states that the reward for studying Torah is equivalent to that of all other mitzvos combined, and the punishment for speaking loshon hora is equivalent to that of all other sins combined. Thus, the antithesis of Torah study, the greatest of all mitzvos, is loshon hora. Their respective primacy can be explained as follows:
?
Of the four basic elements of nature ¡ªfire, wind, water and earth ¡ªthe intangible (fire and wind) are far more powerful than the tangible (water and earth). Fire can engulf material objects and totally destroy them, and the power of wind is awesome, as it is written, ¡°A great and mighty wind which breaks apart mountains and shatters stones¡± (I Melachim?19:11).
?
The same is true in the spiritual realm. Torah study impacts in the Upper Worlds in a way that no other mitzvah can. This is because all other mitzvos are related to the physical ¡ª for example, to fulfill the mitzvah of tzitzis, one dons a garment, a material object; a lulav is held, a physical act; a shofar must be blown, etc. Torah study, however, is performed through the power of speech, which, essentially, is a function of the soul.1 This is why the reward of Torah study is equivalent to that of all other mitzvos combined.
?
The converse is true of sin. The spiritual damage caused by loshon hora is infinitely greater than that caused by other transgressions, because it is committed through the power of speech. Its effect in the Upper Spheres is awesome. Therefore, its punishment is equivalent to that of all other sins combined.
?
?

1. As mentioned above, Targum Onkelos translates ¡°and man became a living being¡±
(Bereishis 2:7), as ¡°and man became a speaking spirit.¡±

Myrtle and Lulav
?
Said the Gerer: "Each one fo us should know his place. You cannot make a myrtle into a lulav. A man, however, can join himself to one who is known to be of more consequence. He then becomes attached to him, even as the myrtle is to the lulav."

Day 9 ¨C Self-Incrimination

?
?
It is forbidden to relate derogatory information about someone even when the speaker mentions that he himself has the very same shortcoming or is guilty of having committed the same act.? This is derived from G-d¡¯s rebuke of the prophet Yeshayah for his having referred to himself as ¡°a man of impure lips dwelling among people of impure lips¡± (Yeshayahu 6:5).
?
Loshon hora cannot be spoken even when it is clear that one is not speaking out of malice or with intention to malign.? Thus, one cannot relate negative information about his loved ones.
?

?
SEFER SHMIRAS HALOSHON
?
Do Whatever You Can (II)

?
¡°Do you really think that you can avoid everything that must not be spoken? Why, you are a man of the world, you have dealings with scores of people!¡± This was another argument cited above, which can lead a person to totally ignore the concept of shmiras haloshon.
?
Again, we respond with an analogy: Let us suppose that I was hurrying somewhere to engage in a business enterprise. A man asks me, ¡°Why do you hurry? Do you think that this enterprise will make you one of the world¡¯s richest men, like So-and-so?¡± Surely I would reply, ¡°Is that a reason not to seek a livelihood for myself?!¡±
?
If this response is correct when material matters are concerned, then surely it applies when spiritual matters are at stake. If one feels that he cannot abide by the laws of forbidden speech with all their details and fine points, does this mean that he should refrain entirely from caring for his soul? Is it reason to allow oneself to, Heaven forbid, be counted among the ba¡¯alei loshon hora (habitual gossipers) who will not merit to bask in the glory of the Divine Presence (Sotah 42a)?
?
Reishis Chochmah (Sha¡¯ar HaAhavah ch. 54) relates that R¡¯ Moshe Cordovero 1 saw the author of Shushan Sodos in a dream [following the latter¡¯s passing], and he was shining like the light of a torch. The deceased revealed that this was in merit of his having avoided idle chatter while on this world. Should such merit be totally forfeited because one feels that to acquire it in its entirety is out of reach?
?
The wisest of men declared, ¡°Whatever you are able to do with your might, do it¡± (Koheles?9:10), meaning that even if one feels he cannot fulfill a given mitzvah in all its fine points, nevertheless, he should strive to fulfill it to the best of his ability. It is in this vein that our Sages derived from the verse, ¡°Then Moshe set aside three cities¡± (Devarim?4:41), that although those three cities could not afford refuge [to one who murdered inadvertently] until the three cities in the Land of Canaan had been set aside ¡ªand Moshe knew that he would not be permitted to enter the Land of Israel and set them aside ¡ªnevertheless, Moshe said: ¡°I will accomplish whatever is in my power to accomplish.¡±2

Day 10 ¨C With Permission

?
?
It is forbidden to speak derogatorily about someone even when the subject has made it known that he does not mind if such things are said of him.
?
As mentioned above, to speak negatively of one¡¯s fellow is shameful in itself, regardless of the subject¡¯s feelings.? Speaking loshon hora is contrary to man¡¯s exalted status as the only creature who was fashioned b¡¯tzelem Elokim, in the Divine image ¨C and this is not altered by the fact that one has been granted permission to speak derogatorily.
?
?

SEFER SHMIRAS HALOSHON
?
Key to Spiritual Success
?
¡°Which man desires life, who loves days of seeing good? Guard your tongue from evil and your lips from speaking deceit. Turn from evil and do good, seek peace and pursue it¡± (Tehillim 34:13-15). The commentators explain that the term ¡°life¡± refers to that of the World to Come, while ¡°days¡± refers to man¡¯s years on this world which are only ¡°days¡± by comparison to the eternal life of the next world.
?
We are commanded to fulfill 613 mitzvos; regarding all of them Hashem says to us, ¡°See that I have placed before you today life and that which is good ... that you should love Hashem, your God, to go in His ways and to observe His commandments¡± (Devarim 30:15-16). Why, then, does David, in the above verse, say that the quality of one¡¯s life in both worlds is primarily dependent on guarding one¡¯s tongue? In the opening passages of this work we have offered one answer to this question. Below, we offer more on the subject:
?
In the preface to Sefer Chofetz Chaim, we explained how the bitter sin of loshon hora can involve transgression of numerous positive and negative commandments, to a degree that is not found with any other sin. Thus, shmiras haloshon is a key to fulfillment of one¡¯s obligations both toward Hashem and toward his fellow Jew.
?
When a person is careful not to speak disparagingly of his fellow, or to embarrass him; when he demonstrates caution in avoiding comments that can aggravate dispute; and when he is careful to avoid transgression of other commandments related to evil talk, both positive and negative, then he will surely avoid more blatant sins. If one accepts upon himself to scrupulously avoid causing harm or shame through the spoken word, surely he will not do so through action!
?
Thus, one who zealously refrains from speaking loshon hora will, through such self-discipline, come to fulfill all his obligations toward his fellow.

The Prodigal's Return
?
Said the Mezeritzer: "A king had two sons. One was contented to be constantly in? attendance on his father; the other preferred to enjoy himself away from home. There evil companions led him astray. The king was prompted to send his officers to fetch him for chastisement, but out of paternal love, refrained form doing so. Later the prodigal regretted the anguish his conduct had caused his father, and of his own free will, returned with a plea for pardon. The king was overjoyed and showed him more love and favor than to the other son who had never absented himself. Likewise, when a grievous sinner returns to the Lord, He receives greater joy and favor than those who have never sinned."

The Straight and the Crooked Road
?
Said the Mezeritzer: "He who always walks on the straight path of righteouness feels no special pleasure in it. He does not know there is a crooked path. But he who has at first walked in the crooked path and later finds the direct path rejoices greatly in his discovery. In the same fashion, the penitent appreciates righteousness more than the saint who has never transgressed."

DON¡¯T TALK DURING DAVENING. GMAR CHATIMA TOVA

¿ªÔÆÌåÓý

?SOURCES FOR NOT TALKING DURING DAVENING-FROM?

1) It is extremely important to refrain from talking ¡°Sichas Chulin- mundane conversation¡± in a Shul, especially during davening and surely during Chazaras HaShatz and Krias HaTorah.

One who talks during Chazaras HaShatz is a sinner, and this sin is too great for any individual?to bear (This is the one and only place the Shulchan Aruch uses such language regarding not keeping a Halacha. The reason for this?is that just as when Kayin killed Hevel he virtually killed half of the world and Hashem told him that his sin is too great to bear, so too one who talks during davening is not only harming himself, but he/she is harming their children and all the other people in the Tzibbur, as when there is talking in Shul it causes the Shechinah to leave, and causes the tefilos of the entire shul to not be ¡°heard and¡± accepted by Hashem.?Based on Tosefos Yom Tov, Sefer HaGan Derech Moshe, Igeres HaKodesh of MaHarDaB of Lubavitch?and other commentaries)

?

2) All Jews are instructed to [respectfully] chastise anyone who talks during Chazaras HaShatz. It should first be done in a way that the offender isn¡¯t being singled out, rather a s a general ¡°announcement¡± to the Shul that it is too noisy. If that doesn¡¯t work, the individual should be approached quietly.

?

If one is told to be quiet and he ridicules the person rebuking him/her, they are subject to the [ quite unpleasant] rules prescribed in the Rambam?(Hilchos De¡¯os Perek 6:7) and may eventually be barred from?entering the Shul. If one will talk in Shul, it is better for him/her to not come in the first place?(Kaf HaChaim Siman 151:8 and Chida in Sefer Pesach Einayim)

?

This is not a Minhag (custom), Chumra (stringency) or Midas Chasidus (something only pious people do). It is an undisputed Halacha Mefureshes in Shulchan Aruch Siman 124:7 with its source in the words of Chazal and the Rishonim.

?

3) Many sharp words have been written about the gravity and dire consequences of transgressing the sin of talking during davening, yet unfortunately too many otherwise religious Jews are still very lax when it comes to talking in Shul. Below is just a small sampling of the plethora of sources bemoaning this sinful practice, in the hopes that it may help people to start taking this Halacha more seriously and thus hasten the coming of Mashiach:

¡¤????????One who talks?while the Tzibbur is praising Hashem Yisborach (i.e. during Chazaras HaShatz) is showing that he wants no part in [the praising of] Hashem?(Shulchan Aruch HaRav Siman 124:10 quoting the?Zohar in Parshas Terumah)

¡¤????????Woe is to those that talk during Chazaras HaShatz, as many Shuls throughout Jewish history have been destroyed due to this sin.?(Mishna Berura 124:27 quoting the Elya Rabbah)

¡¤????????Many Shuls have been turned into churches due to the fact that talking took place in those Shuls.?(Mogen Avraham Siman 151)

¡¤????????One who talks during davening, his mouth becomes ¡°Tamei- impure¡±, and when he davens with this mouth it is as if he is being Oved Avoda Zara- serving idols?(Drashos Chasam Sofer Vol. 2?Drasha for 7 Av)

¡¤????????One who [habitually] talks during davening has no portion in Olam Haba, the world to come.?(Sefer M¡¯Am Loez Parshas Bamidbar)

¡¤????????The holy Rebbe of Gur, the Imrei Emes Zatzal, was known to have said that the tragedy of the holocaust that befell the Jewish people and cost us 6,000,000 lives, was brought upon us due to the sin of talking during davening, and the reason the Sephardic communities were for the most part spared, was due to their being scrupulous in not talking during davening?(Quoted in Sefer Tuvecha Yabiu Vol. 2 Page 321)

¡¤????????Talking during Tefilah is delaying?the Geulah (final redemption/coming of Mashiach)?(Sefer Yesh Nochlin from?the father of the Shl¡±a HaKadosh. See also Sefer Mikdash Me¡¯at Page 27 and Shu¡±t Yabia Omer Vol. 1 Siman?10:11)

¡¤????????Talking during davening is the worst sin a Jew can do! It causes the Yetzer Hara to become empowered over the person, and one who talks during davening is a Choteh U¡¯Machtee Es HaRabim- causes others to follow in his ways and sin as well, and is degrading the glory of Hashem?(Sefer Yesh Nochlin ibid.)

?

4) Every Shul should appoint?a G-d fearing, strong person to be a Mashgiach to??reprimand and punish those who talk during davening?(Vavei HaAmudim quoted in?Pri Megadim Siman 124:11, and in Mishna Berura 124:27).

?

The congregation should support and assist the aforementioned ¡°Mashgiach¡±, and by doing so they will merit having their Tefilos answered.?(Sefer Birchas HaBayis Sha¡¯ar 42)

In the zechus of strengthening ourselves in this important area, may we be zoche to the speedy arrival of Mashiach!

Day 8 ¨C Past History

?
Another area involving loshon hora is that of past history.? It is forbidden to relate something about an individual¡¯s past which either the speaker or the listener considers shameful, though in reality it is not shameful at all.
?
Our Sages teach that ¡°at the place where baalei teshuvah (returnees to the path of Torah) stand, perfect tzaddikim (those who have always been righteous) cannot stand¡± (Berachos 34b).? Thus, there is nothing shameful about a baal teshuvah.? Nevertheless, it is forbidden to relate that someone is a baal teshuvah if either the speaker or the listener looks down at such people.? (Related laws regarding baalei teshuvah will be discussed in Day 20).
?

?
SEFER SHMIRAS HALOSHON

?
Do Whatever You Can (I)
?
A Torah scholar once posed the following question: If one has failed to concentrate while reciting the Shemoneh Esrei prayer and finds himself near its conclusion, with what approach can he inspire himself to pray the remainder of the prayer with proper concentration? The scholar offered a solution by way of a parable:
?
A young girl was standing in the marketplace with a large basket of apples for sale. Suddenly, a thief approached and began to snatch apples out of the basket. The girl became confused and stood helplessly, not knowing what to do. Someone who was watching from a distance called out to her, ¡°Why are you standing still? What are you waiting for ¡ªthat he should grab everything? Just as he is grabbing, so should you grab-? whatever you can get will still be yours!¡±
?
And so it is regarding prayer. If one was overcome by lethargy and mindless daydreaming at the start of the Shemoneh Esrei, and suddenly finds himself near the prayer¡¯s end without having ¡°grabbed any apples,¡± this does not mean that he should give up and leave himself with nothing. Rather, he should strive with all his inner strength to concentrate on the remaining blessings.
?
And so it is, exactly, with shmiras haloshon. You stumbled this morning and spoke the forbidden? Then stand ready this afternoon to overcome your evil inclination and refrain from forbidden talk. And if you fail in the afternoon, nevertheless, strengthen yourself to do battle once more tomorrow. Surely Hashem will help you to succeed, for ¡°one who seeks to purify himself is granted Heavenly assistance¡± (Shabbos 104a).
