The conditions for a statement to be considered proper, constructive speech, rather than prohibited rechilus, are almost identical to those which permit communicating information that would otherwise be considered loshon hora (i.e.
information that is derogatory or harmful). In fact, a study of the situations which permit rechilus l¡¯toeles (for a constructive purpose) will reveal that virtually every case involves loshon hora as well.

As discussed above, among the reasons which permit speaking rechilus for a constructive purpose are the prevention or termination of harm, or gaining restitution for harm caused by the subject. Such statements invariably incriminate the subject, and are therefore
loshon hora. Thus, for rechilus to be spoken for a constructive purpose, all conditions which permit speaking loshon hora for a constructive purpose must be met as well.

Conversely, not all motives that justify negative speech qualify as a constructive purpose to permit speaking rechilus. While one may publicize the wrongdoings of an individual if social pressure could bring about a change in his behavior, one could not do
so if the victim is as yet unaware of the individual¡¯s identity. The evils of causing animosity between the victim and villain outweigh the possibility that social pressure will yield concrete constructive results.

How careful must a Jew be not to rejoice over his fellow¡¯s downfall or disgrace! As Scripture states, ¡°When your enemy falls be not glad, and when he stumbles, let your heart not be joyous. Lest Hashem see it and it displease Him, and He will turn His wrath
from him [to you]¡¯¡¯ (Mishlei 3:5). To rejoice over another¡¯s failures is to direct the Attribute of Judgment toward oneself in a powerful way. Moreover, this sin has the destructive power of idol worship. The Sages relate (Midrash Eichah 1:21) that at the
time of the First Destruction the soul of the Patriarch Avraham entered the Temple ruins. ¡°What is My beloved doing in My house?¡¯¡¯ asked Hashem. Responded Avraham, ¡°Why have my descendants been cast into exile among the nations of the world?¡¯¡¯ Hashem answered,
¡°Because they worship idols and rejoice over each other¡¯s downfall.¡¯¡¯ Thus, Hashem equates these two sins.

One should forever reflect upon his own spiritual failings so that he will be reminded that he too is deserving of shame and scorn. It is the merits of his ancestors, coupled with other factors for which he can take no credit that Hashem, in His mercy, spares
him from shame. With this outlook, one will truly empathize with those who experience failure and disappointment in their personal lives.

Welcome to the first day of the rest of your life. This year we are overjoyed to have Eliahu Rosenbloom back as Ba¡¯al Musaf, Moshe Rothkopf Shacharis, Yerachmiel Neuman Shofar and Piseukei dZimra.

D'var Torah Parshat Nitzavim /Rosh Hashanah. On Rosh Hashanah, it is customary to bring to the table simanim: An apple with honey - so that we have a good and sweet year, a pomegranate - to increase our merits like a pomegranate, etc. We also bring a fish head, and say "May we be like the head and not the tail." A student sent a question to his rabbi revealing how bad his marriage relationship was. The climax came on Rosh Hashanah, he wrote, when his wife handed him not the fish head, the tail - and told him: "Everyone gets what they deserve ." The guy was broken, his whole Rosh Hashanah was destroyed and he does not know how to pick up the shattered pieces of his marriage. What would you do in such a situation? Between you and me, do we really care to eat the tail? What's the deeper meaning behind eating the head and saying "We will be like the head and not the tail"? One reason is that the head refers to a leader, and the tail is to be led. Each of us wants to be good, but sometimes we are drawn to nonsense - passions, temptations, bad qualities. We want to be in the lead - to lead ourselves where we want to go, not to be a "tail" - not to be led¡ A person who receives a tail on the night of Rosh Hashana, if he receives it with love, does not need the symbolism of a fish head, because he is already ahead!! He is already leading, he knows how to overcome his difficulties. In contrast, a person who receives the head, but from every little thing gets upset, from every temptation he breaks even if he eats a thousand heads he is still a tail - because he is being led. The weekly Torah portion begins:? ?????? ????????? ??????? ????????? ??????? ?' ??????????, ?????????? ??????????? ?????????? ?????????????... ???????? ????????? ???????? ?????? ???????? ????????? ??????? ??????? ??? ?????? ????????Says the holy Zohar explains,? ?"?????? ????????? ???????" The idea is to uplift ourselves, especially on the last Shabbat of the year to be strong and realize that we all are, as well as life itself,? a little more complex than we thought. What is important is not to run away from ourselves or the difficulties life throws at us, yet to be grounded - "you stand", to be strong - to choose to lead and to believe in a better future and a good, sweet year, even if we and those around us stumble, remember to be a Rosh - i.e. " To do the will of our Father in heaven.? Therefore, one cannot inform a person that someone else is about to harm him if the person will respond by harming the plotter. This applies not only to physical or financial retaliation, but even to retaliation in the form of loshon hora in a manner prohibited
by halachah.

In summation: A Jew must strive to develop positive character traits, especially with regard to traits that have a major impact on interpersonal relationships. One must strive to assist his fellow to the best of his ability and overlook his fellow¡¯s faults
just as he would want others to overlook his own faults. If one¡¯s friend has expressed his anger toward someone else, he should do his best to soothe that anger through reason and explanation ¡ª a demonstration of true wisdom and inner strength.
?
A wicked person behaves in the very opposite way. He seeks to damage others, to reveal their unintentional misdeeds and claim that they were committed willfully. The wicked person rejoices over another¡¯s failings, and incites others to feud. He prides himself
over his success in such endeavors, as he considers this an indication of his wisdom and might ¡ª but of course he is wrong.

Midrash Shochar Tov (ch. 52) cites the episode of Doeg¡¯s treachery against David and Achimelech, the Kohen Gadol (High Priest). At a time when King Shaul was in pursuit of David and seeking to harm him, Doeg told Shaul that Achimelech had intentionally helped
David to flee from Shaul, which was a lie. Doeg¡¯s slander brought about Achimelech¡¯s death (see I Shmuel chs. 21-22).

As the Midrash relates, David told Doeg, ¡°Is a man truly mighty when he sees his fellow at the edge of a pit and pushes him in, when he sees his fellow on top of a roof and pushes him off? On the contrary, a man deserves to be called a mighty warrior when his
fellow is about to fall into a pit and he grasps his hand to prevent his fall or when he lifts the fallen man from the pit. But when you saw that Shaul was angry at me, you persisted in vilifying me.¡¯¡¯ Thus did David say, ¡°Why do you pride yourself with evil,
O mighty warrior?¡¯¡¯ (Tehillim 52:3).

As with loshon hora, one may not relate rechilus for a constructive purpose if this purpose can be accomplished through other means (see Day 46).

Of course, easiest of all is the direct approach ¨C informing the potential victim of what is being plotted and allowing him to fend for himself. The Torah, however, views this avenue as a last resort. If the option exists, one must protect the victim without
his even suspecting that someone is attempting to harm him. (This option does not apply where it is important for the potential victim to be on guard should the other party attempt to harm him at a later point in time.)???

Obviously, there is a limit to how much effort one is required to invest in protecting his fellow Jew from harm when the person is fully capable of protecting himself. If, in order to avoid involving the potential victim, one would have to dedicate an unreasonable
amount of time and energy, it would be permissible to inform the person so that he can protect himself.

One should ponder the fact that at the moment he speaks loshon hora, the Heavenly angels announce his own sins (Roke¡¯ach, Aggadas Mishlei 11:27).
?
Riva (cited by Semak 283) states that if one kills someone who is attempting to commit a capital crime against his fellow (and, as such, should be killed if that is the only way to ensure that the crime will not be committed) and later is guilty of that very
same offense, then retroactively, he is considered as if he had shed innocent blood. As proof, Riva cites the episode of King Yeihu who, in killing the members of King Achav¡¯s household, was fulfilling the Divine will as transmitted through prophecy. Yet because
Yeihu too was guilty of a degree of idol worship ¡ª though his infractions did not approach the heinous acts of Achav ¡ª he was held responsible for murdering Achav¡¯s household, as it is written, ¡°And I shall bring to account the blood of [Achav who was killed
in] Yizrael upon the house of Yeihu¡± (Hoshea 1:4).
?
The same applies to any sin between man and his fellow. If one rightfully attacks someone physically (to prevent him from committing a crime), or embarrasses him (for his having publicly disgraced Hashem¡¯s Name), or speaks negatively about him (to prevent him
from causing someone else harm), and has committed or later commits that very same offense, then he is considered as if he had acted or spoken against an innocent man. Consequently, he will be subject to Divine retribution as if he had acted or spoken against
a Jew whose service of Hashem is wholesome and beyond reproach. |

If a person was present when a statement was made or an act was committed by an individual, and then someone else who was present points out to the person that the act was intended to hurt him, he may not believe this interpretation
of what had transpired. Not only is it wrong to believe a report that is rechilus, it is also prohibited to accept an insight that transforms an innocent occurrence into a malicious act.

A Contradiction
?
The gossiper should be filled with shame over his blatant disregard for the transgressions which he regularly commits, for surely he believes that every letter of the Torah is true and God-given.
?
Imagine that the gossiper were called to the Torah and the portion to be read contained one of the verses which prohibits loshon hora, such as ¡°Do not go as a gossipmonger among your people¡± (Vayikra 19:16); ¡°Accursed is one who strikes his fellow stealthily¡±
(Devarim 27:24); ¡°Remember that which Hashem, your God, did to Miriam¡± (Bamidbar 24:9); ¡°Do not accept a false report¡± (Shemos 23:1); etc. As the gossiper looks at the scroll¡¯s words before reciting the opening blessing he notices that one of the letters in
one of the above verses is missing a point, rendering it invalid. Surely he would not recite the blessing, for he knows that in order to be valid the Torah scroll must be complete, and that not a single letter may be deficient in any way. The gossiper clearly
believes that every letter of the holy Torah is true. Why then does he totally disregard these verses in practice?!
?
As mentioned above, a person should choose at least one mitzvah to which he will dedicate himself with utmost devotion. There is particular benefit in selecting the mitzvah to guard one¡¯s tongue as one¡¯s singular mitzvah. We can liken this to earning a livelihood.
The average person would prefer to have a steady livelihood which earns him a modest but predictable profit, as opposed to a business which may bring him large profits, but without any sort of regularity or predictability. The mitzvah of shmiras haloshon can
accrue merit day and night in virtually any situation. Whether one is at home, in the study hall, market, or at a social gathering, he is forever presented with opportunities to refrain from speaking and listening to the forbidden. And as the Sages teach,
¡°One who sits and does not commit a sin is granted reward equivalent to that of one who performs a mitzvah¡± (Kiddushin 39b).
