Teshuva from Halacha For Today

CURRENT TOPIC:
Review of Halachos of Yamim Noraim
1) The Aseres Yemei Teshuva, and particularly Erev Yom Kippur, is the ideal time to apologize, beg forgiveness and ask for Mechila from anyone that we may have slighted in any way throughout the previous year?(or longer).
?
Sins that require Mechila from another human being will not be wiped away with Teshuva alone, until forgiveness is sought. If one asks you for Mechila, you should find it in your heart to forgive them.?(Mateh Ephraim Siman 606:1)
?
The Poskim say that if the one who wronged you does not come to you to ask for Mechila, then you?(the victim)?should go to him/her and present yourself to him/her in such a way to encourage them to ask you for forgiveness?(Mateh Ephraim Siman 606:3 based on Talmud in Yoma 87a).?The Seforim compare this to us and Hashem. In the Yemei HaTeshuva Hashem comes down from Shamayim and makes it easy for us to ask - and receive - His divine forgiveness, as it says in the Posuk?"Dirshu Hashem B'HiMatzo - Seek out Hashem when He is near".
?
Asking Mechila in a general way (e.g. "Are you Mochel way for anything and everything I may have done etc.) is sufficient for minor infractions only. However if you wronged someone in a significantly harmful way?(spoke scandalous Lashon Hara or Motzi Shem Ra about them, caused them significant monetary damage etc.)?you must beg their forgiveness specifically for that infraction, and must verbalize the details upon asking.?(Mateh Ephraim Siman 606:2)
?
If you spoke Lashon Hara about somebody and they don't know about it, and by revealing it to them (in order to ask forgiveness) you will cause them additional pain and anguish , it is a dispute amongst the Poskim as to the best course of action.
?
Rav Yisroel Salanter Zatzal maintained that if by going over to the person who you spoke against to ask for mechilah will cause them further harm, it is best not to let them know, and try to do as much Teshuva as possible, and try to spread good about that person in other ways.?(Rav Shlomo Zalmen Auerbach Zatzal ruled according to this opinion)
?
The Chofetz Chaim Zatzal?(Hilchos Lashon Hara Klal 4:12)?ruled that Teshuva was only complete with mechila, and even if it caused further harm, you must approach them.?For Halacha L'Ma'aseh, of course, a Rav must be consulted.
?
It goes without saying that when asking for forgiveness it must be sincere and you must genuinely regret what you did and resolve not to do it again. Simply mouthing the words "Are you Mochel me?" isn't sufficient. Likewise, the one who says "I am Mochel you" but doesn't really mean it, and continues to bear a grudge in his heart, is doing a disservice for all parties involved.
?
2) When forgiving someone, it is extremely important to verbalize this fact by saying "I am Mochel you with my whole heart".?(See Rabbeinu Bechaya Bereishis 50:17 where explains that Yosef HaTzadik was Mochel his brothers, the Shevatim , in his heart, but never verbalized this thought, thus the Asara Harugei Malchus and many other Tzaros needed to befall Klal Yisroel over the ages. There is a lengthy discussion about this, but this forum is not the place)

After receiving forgiveness from the people that we hurt, there are still 24 things?(Brought by Rabbeinu Yonah in Sharei Teshuva, end of Sha'ar 1. They can also be found more at length in the Rambam Perek 4 of Hilchos Teshuva. The original source for this seems to be a Tosefta)?that are Me'Akev - prevent - proper Teshuva from being attained.
?
Obviously it is best to try and make sure that we don't have any of these impediments in our day to day lives, so we can assure that our Teshuva is easily attained and properly accepted by Hashem.?Most of these things are probably not relevant to most of the people reading this, but it is still Halacha, and can be used as a catalyst for Teshuva in other areas in which we may indeed need rectification.?
?
The 24 obstacles to Teshuva are:?(Loose translation. It would be too lengthy for this forum to delve into the details of each one)?
?
1.??????One who frequently spreads Rechilus (slanderer)
2.??????One who regularly speaks Lashon Hara (Gossiper)
3.??????One who gets angry quickly
4.??????One whose bad (impure) thoughts control him
5.??????Being connected to a rasha (evildoer)
6.??????Taking from food that isn't sufficient for its owner
7.??????Gazing at Arayos with sinful intent
8.??????Partnering with a thief
9.??????One who says "I will sin and repent afterwards" or " I will sin and Yom Kippur will atone for the sin"
10.??One who derives honor [and pleasure] from his fellow man's humiliation.
11.??One who separates him/herself from the Tzibbur (congregation).
12.??One who ridicules his forefathers and/or teachers
13.??One who curses the public
14.??One who prevents a group of people from doing a Mitzvah
15.??One who causes another Jew to leave the good path and take a bad path [of living not according to the Torah]
16.??One who uses the pillow of a poor person [i.e. causes a poor person to lose the use of any of his meager possessions]
17.??One who accepts bribes in order to skew and distort justice from prevailing.
18.??One who finds a lost object and doesn't [try and] return it to its proper owner.
19.??One who sees their child going off the [Torah] path, and doesn't admonish them.
20.??One who eats [i.e. usurps] the food [i.e. livelihood] of poor people, orphans or widows.
21.??One who argues [and does an action] against the will of the sages.
22.??One who accuses good people of doing wrong [without proper proof or reason]
23.??One who hates [and cannot accept constructive] criticism.

?Is the night before Yom Kippur also considered Erev Yom Kippur? And if it is, is it therefore considered a mitzvah to eat more?


Answer:

?It is Erev Yom Kippur.

However, according to most Poskim the Mitzvah to eat begins at daybreak. (See Biur HaGra to Siman 604, Magen Avrohom Siman 604 and He¡¯emek sh¡¯eilah from the Netziv Parshas V¡¯Zos HaBracha Siman 169:1)

Some Poskim say that the Mitzvah already begins at Shkiah of the eve of Erev Yom Kippur, but even they agree that the main Mitzvah is by day. (See Bach Siman 604)

SOURCES FOR NOT TALKING DURING DAVENING-FROM?

1) It is extremely important to refrain from talking ¡°Sichas Chulin- mundane conversation¡± in a Shul, especially during davening and surely during Chazaras HaShatz and Krias HaTorah.


One who talks during Chazaras HaShatz is a sinner, and this sin is too great for any individual?to bear (This is the one and only place the Shulchan Aruch uses such language regarding not keeping a Halacha. The reason for this?is that just as when Kayin killed Hevel he virtually killed half of the world and Hashem told him that his sin is too great to bear, so too one who talks during davening is not only harming himself, but he/she is harming their children and all the other people in the Tzibbur, as when there is talking in Shul it causes the Shechinah to leave, and causes the tefilos of the entire shul to not be ¡°heard and¡± accepted by Hashem.?Based on Tosefos Yom Tov, Sefer HaGan Derech Moshe, Igeres HaKodesh of MaHarDaB of Lubavitch?and other commentaries)

?

2) All Jews are instructed to [respectfully] chastise anyone who talks during Chazaras HaShatz. It should first be done in a way that the offender isn¡¯t being singled out, rather a s a general ¡°announcement¡± to the Shul that it is too noisy. If that doesn¡¯t work, the individual should be approached quietly.

?

If one is told to be quiet and he ridicules the person rebuking him/her, they are subject to the [ quite unpleasant] rules prescribed in the Rambam?(Hilchos De¡¯os Perek 6:7) and may eventually be barred from?entering the Shul. If one will talk in Shul, it is better for him/her to not come in the first place?(Kaf HaChaim Siman 151:8 and Chida in Sefer Pesach Einayim)

?

This is not a Minhag (custom), Chumra (stringency) or Midas Chasidus (something only pious people do). It is an undisputed Halacha Mefureshes in Shulchan Aruch Siman 124:7 with its source in the words of Chazal and the Rishonim.

?

3) Many sharp words have been written about the gravity and dire consequences of transgressing the sin of talking during davening, yet unfortunately too many otherwise religious Jews are still very lax when it comes to talking in Shul. Below is just a small sampling of the plethora of sources bemoaning this sinful practice, in the hopes that it may help people to start taking this Halacha more seriously and thus hasten the coming of Mashiach:


¡¤????????One who talks?while the Tzibbur is praising Hashem Yisborach (i.e. during Chazaras HaShatz) is showing that he wants no part in [the praising of] Hashem?(Shulchan Aruch HaRav Siman 124:10 quoting the?Zohar in Parshas Terumah)


¡¤????????Woe is to those that talk during Chazaras HaShatz, as many Shuls throughout Jewish history have been destroyed due to this sin.?(Mishna Berura 124:27 quoting the Elya Rabbah)


¡¤????????Many Shuls have been turned into churches due to the fact that talking took place in those Shuls.?(Mogen Avraham Siman 151)


¡¤????????One who talks during davening, his mouth becomes ¡°Tamei- impure¡±, and when he davens with this mouth it is as if he is being Oved Avoda Zara- serving idols?(Drashos Chasam Sofer Vol. 2?Drasha for 7 Av)


¡¤????????One who [habitually] talks during davening has no portion in Olam Haba, the world to come.?(Sefer M¡¯Am Loez Parshas Bamidbar)


¡¤????????The holy Rebbe of Gur, the Imrei Emes Zatzal, was known to have said that the tragedy of the holocaust that befell the Jewish people and cost us 6,000,000 lives, was brought upon us due to the sin of talking during davening, and the reason the Sephardic communities were for the most part spared, was due to their being scrupulous in not talking during davening?(Quoted in Sefer Tuvecha Yabiu Vol. 2 Page 321)


¡¤????????Talking during Tefilah is delaying?the Geulah (final redemption/coming of Mashiach)?(Sefer Yesh Nochlin from?the father of the Shl¡±a HaKadosh. See also Sefer Mikdash Me¡¯at Page 27 and Shu¡±t Yabia Omer Vol. 1 Siman?10:11)


¡¤????????Talking during davening is the worst sin a Jew can do! It causes the Yetzer Hara to become empowered over the person, and one who talks during davening is a Choteh U¡¯Machtee Es HaRabim- causes others to follow in his ways and sin as well, and is degrading the glory of Hashem?(Sefer Yesh Nochlin ibid.)

?


4) Every Shul should appoint?a G-d fearing, strong person to be a Mashgiach to??reprimand and punish those who talk during davening?(Vavei HaAmudim quoted in?Pri Megadim Siman 124:11, and in Mishna Berura 124:27).

?

The congregation should support and assist the aforementioned ¡°Mashgiach¡±, and by doing so they will merit having their Tefilos answered.?(Sefer Birchas HaBayis Sha¡¯ar 42)


In the zechus of strengthening ourselves in this important area, may we be zoche to the speedy arrival of Mashiach!
